地理標(biāo)志產(chǎn)品永濟(jì)蘆筍知識(shí)產(chǎn)權(quán)保護(hù)調(diào)研報(bào)告

【摘要】:永濟(jì)市氣候濕潤(rùn),光照充足,其得天獨(dú)厚的地理環(huán)境造就了永濟(jì)蘆筍的獨(dú)特品質(zhì)。2008年2月國(guó)家質(zhì)量監(jiān)督檢驗(yàn)檢疫總局核準(zhǔn)了對(duì)永濟(jì)蘆筍實(shí)行地理標(biāo)志產(chǎn)品保護(hù),正式將其納入國(guó)家法律保護(hù)的范疇。盡管我國(guó)現(xiàn)階段對(duì)地理標(biāo)志的保護(hù)措施并未達(dá)到對(duì)商標(biāo)、專(zhuān)利等其他知識(shí)產(chǎn)權(quán)的保護(hù)力度,但是逐步健全對(duì)地理標(biāo)志產(chǎn)品的法律保護(hù)卻有利于提高產(chǎn)品本身的市場(chǎng)競(jìng)爭(zhēng)力。專(zhuān)利、商標(biāo)等知識(shí)產(chǎn)權(quán)乃至所有私法的立法目的都難以回避其本身所具有的經(jīng)濟(jì)價(jià)值,因此地理標(biāo)志所具有的效益價(jià)值,才是其存在的關(guān)鍵所在。永濟(jì)蘆筍在被核準(zhǔn)成為地理標(biāo)志保護(hù)產(chǎn)品之后,本應(yīng)朝著更好的方向發(fā)展。但是近年來(lái),地理標(biāo)志產(chǎn)品永濟(jì)蘆筍知識(shí)產(chǎn)權(quán)保護(hù)中卻存在著地理標(biāo)志法律意識(shí)不強(qiáng)、專(zhuān)用標(biāo)志零申請(qǐng)率、專(zhuān)用標(biāo)志冒用情況嚴(yán)重等各種問(wèn)題,導(dǎo)致“地理標(biāo)志產(chǎn)品”的品牌效應(yīng)并未發(fā)揮其應(yīng)有的作用。本文希望通過(guò)對(duì)永濟(jì)蘆筍地理標(biāo)志的保護(hù)現(xiàn)狀進(jìn)行調(diào)研,進(jìn)而探析永濟(jì)蘆筍在知識(shí)產(chǎn)權(quán)綜合保護(hù)中存在的問(wèn)題,通過(guò)整理相關(guān)材料以及各項(xiàng)數(shù)據(jù),以期尋找解決方法,為永濟(jì)蘆筍地理標(biāo)志的區(qū)域性品牌發(fā)展提出有效并具有可行性的保護(hù)對(duì)策。本論文共包括四個(gè)部分:第一部分主要是簡(jiǎn)單介紹永濟(jì)蘆筍的基本情況。第二部分主要闡述了對(duì)永濟(jì)蘆筍地理標(biāo)志產(chǎn)品保護(hù)的調(diào)查結(jié)果。包括消費(fèi)者對(duì)地理標(biāo)志產(chǎn)品永濟(jì)蘆筍的了解狀況、加工企業(yè)以及地方政府對(duì)永濟(jì)蘆筍知識(shí)產(chǎn)權(quán)保護(hù)的具體措施等內(nèi)容。第三部分的內(nèi)容主要是對(duì)永濟(jì)蘆筍知識(shí)產(chǎn)權(quán)保護(hù)中存在的問(wèn)題及其成因進(jìn)行詳細(xì)的論述。第四部分主要是針對(duì)影響永濟(jì)蘆筍地理標(biāo)志知識(shí)產(chǎn)權(quán)保護(hù)中存在的問(wèn)題提出具體的解決對(duì)策,具體包括加強(qiáng)政府的宣傳力度、完善地方知識(shí)產(chǎn)權(quán)保護(hù)制度、完善地理標(biāo)志保護(hù)的實(shí)施體系、鼓勵(lì)企業(yè)積極申請(qǐng)專(zhuān)用標(biāo)志的使用權(quán)等。
[Abstract]:Yongji has a humid climate and sufficient light, and its unique geographical environment has created the unique quality of Yongji asparagus. In February 2008, the State Administration of quality Supervision, Inspection and Quarantine approved the implementation of geographical indication product protection for Yongji asparagus. It is formally included in the scope of national legal protection. Although the protection measures for geographical indications in our country at present have not reached the level of protection of trademarks, patents and other intellectual property rights, the gradual improvement of the legal protection of geographical indication products is conducive to improving the market competitiveness of the products themselves. It is difficult to avoid the economic value of patent, trademark and even all the legislative purposes of private law, so the benefit value of geographical indication is the key to its existence. Yongji asparagus, which has been approved as a geographical indication protection product, should have moved in a better direction. However, in recent years, there are some problems in the protection of intellectual property rights of Yongji asparagus, such as weak legal consciousness of geographical indications, zero application rate of special marks, serious misuse of special marks, etc. The brand effect of "geographical indication product" did not play its due role. This paper hopes to investigate the status quo of the protection of geographical indications of asparagus in Yongji, and then analyze the problems existing in the comprehensive protection of intellectual property rights of asparagus in Yongji, through collating the relevant materials and data, in order to find a solution. This paper puts forward effective and feasible protection countermeasures for regional brand development of geographical indication of asparagus in Yongji. This paper includes four parts: the first part is a brief introduction to the basic situation of Yongji asparagus. The second part mainly elaborated the investigation result of the Yongji asparagus geographical indication product protection. Including consumers' understanding of the geographical indication product Yongji asparagus processing enterprises and local governments to protect the intellectual property rights of Yongji asparagus and other specific measures. The third part mainly discusses the problems and causes of intellectual property protection in Yongji asparagus. The fourth part is mainly to put forward specific solutions to the problems affecting the protection of geographical indication intellectual property of Yongji asparagus, including strengthening the propaganda of the government and perfecting the local intellectual property protection system. Improve the implementation system of geographical indication protection, encourage enterprises to actively apply for the use of special signs.
