【摘要】：著作權(quán)的研究范圍十分廣泛,不僅包括傳統(tǒng)意義上的著作權(quán),也包括網(wǎng)絡(luò)著作權(quán),傳統(tǒng)意義上的著作權(quán)大家都較為熟悉,所以本文將重點(diǎn)介紹關(guān)于對(duì)網(wǎng)絡(luò)視聽作品著作權(quán)的研究。網(wǎng)絡(luò)的發(fā)展日新月異,帶給我們便利,提高生活的節(jié)奏,加快了人類文明成果的傳揚(yáng)與發(fā)展。但是網(wǎng)絡(luò)也是一把雙刃劍,網(wǎng)絡(luò)的虛擬性,局限性讓我們看到了它的弊端。隨著經(jīng)濟(jì)全球化,世界多極化的發(fā)展趨勢(shì),世界各地的文明成果資源共享,網(wǎng)絡(luò)的運(yùn)用更加廣泛,隨之而來網(wǎng)絡(luò)著作權(quán)的話題討論也更加頻繁。我國(guó)《著作權(quán)法》保護(hù)的作品是指文學(xué),藝術(shù)以及科學(xué)領(lǐng)域內(nèi)專有,獨(dú)創(chuàng)的智力成果�！吨鳈�(quán)法》從保護(hù)文字作品延伸到相片,影像,軟件等多媒體作品,得到法律的保護(hù),同時(shí)也受到法律的制約。近年來,因網(wǎng)絡(luò)著作權(quán)而引起的糾紛案件不絕于耳,人們?cè)谙硎芫W(wǎng)絡(luò)帶來的便利同時(shí)也時(shí)刻需反省其帶來的弊端。但在網(wǎng)絡(luò)著作權(quán)在法律方面的規(guī)定卻存在一些不足的地方,例如侵權(quán)形式,對(duì)著作權(quán)人人身保護(hù)方面。本文將通過以下幾個(gè)觀點(diǎn),闡明對(duì)網(wǎng)絡(luò)著作權(quán)的理解:網(wǎng)絡(luò)著作權(quán)的歸屬,網(wǎng)絡(luò)著作權(quán)歸屬的特殊問題以及歸屬后的合理使用問題等。
[Abstract]:The scope of copyright research is very extensive. It includes not only copyright in the traditional sense, but also network copyright. In the traditional sense, everyone is familiar with copyright. Therefore, this paper will focus on the network audio-visual works copyright research. The rapid development of the network brings us convenience, improves the rhythm of life, and speeds up the spread and development of the achievements of human civilization. But the network is also a double-edged sword, the virtual nature of the network, limitations let us see its drawbacks. With the globalization of economy and the trend of multipolarization in the world, the resources of civilization achievements are shared all over the world, the application of network is more extensive, and the topic of network copyright is discussed more frequently. The works protected by the copyright Law of China refer to the exclusive and original intellectual achievements in the field of literature, art and science. The copyright Law extends from protecting written works to multimedia works such as photographs, images, software, and so on, and is protected by law. At the same time, it is also restricted by the law. In recent years, the disputes caused by the network copyright cases are endless, people enjoy the convenience brought by the network, but also need to reflect on its disadvantages. However, there are some deficiencies in the legal provisions of network copyright, such as the form of infringement and the protection of the copyright owner's habeas corpus. This paper will clarify the understanding of network copyright through the following points of view: the ownership of network copyright, the special problems of network copyright attribution, and the reasonable use of network copyright after attribution.
