【摘要】：2014年我國迎來首次胚胎繼承案件,從一審的胚胎不能繼承,到二審改判雙方四位夫婦共同監(jiān)管和處置4枚冷凍胚胎。冷凍胚胎這個(gè)新科技生物輔助技術(shù)下的產(chǎn)物走進(jìn)了我們的視野。胚胎在民法界具有其特殊的意義,關(guān)于冷凍胚胎的法律屬性有主體說、客體說、中介說三種觀點(diǎn)。冷凍胚胎的法律屬性具有雙重性,冷凍胚胎應(yīng)是一種特殊的物,屬于特殊的倫理物,其在繼承和分析定位方面應(yīng)該區(qū)別于普通物概念。但是我國現(xiàn)行法律并沒有對(duì)胚胎“物”的正確法律地位做出有關(guān)條款的規(guī)定,關(guān)于冷凍胚胎繼承的糾紛日后定會(huì)時(shí)有發(fā)生,將會(huì)得不到及時(shí)的解決。筆者認(rèn)為胚胎繼承糾紛主要表現(xiàn)為道德評(píng)價(jià)標(biāo)準(zhǔn)與法律規(guī)定之間價(jià)值沖突。平衡新聞媒體、公眾道德評(píng)論與司法機(jī)關(guān)評(píng)定胚胎地位的價(jià)值沖突是制定胚胎正確法律地位規(guī)則的目的所在。筆者試通過我國對(duì)民法上物的概念分析并通過借鑒國外的胚胎繼承案相關(guān)判例,對(duì)胚胎的正確法律地位及胚胎“物”的繼承性展開論述,同時(shí)從合理保護(hù)我國公民應(yīng)有權(quán)利的角度,來共同構(gòu)建我國胚胎的相關(guān)法律制度。胚胎是新世紀(jì)科學(xué)技術(shù)發(fā)展隨之帶來的新產(chǎn)物,如何來界定胚胎的法律地位?胚胎究竟享有人還是物的權(quán)利?這個(gè)問題已經(jīng)在世界各國各個(gè)相關(guān)領(lǐng)域引起強(qiáng)烈的爭(zhēng)論。確定胚胎的法律地位,對(duì)于我國相關(guān)法律制度的完善和我國醫(yī)學(xué)輔助技術(shù)的規(guī)范,都將起到具有重大的作用。
[Abstract]:In 2014, China ushered in the first case of embryo inheritance, from the first instance of the embryo can not be inherited to the second instance of the two sides four couples to jointly supervise and dispose of four frozen embryos. The legal attribute of frozen embryo is a special kind of thing and belongs to a special ethical thing. It should be different from the concept of ordinary thing in inheritance and analysis orientation. However, the current law of our country has not made the correct legal status of embryo "thing". Disputes over frozen embryo inheritance will occur from time to time in the future and will not be settled promptly. The author tries to discuss the correct legal status of the embryo and the inheritance of the embryo "thing" by analyzing the concept of the object in the civil law of our country and by referring to the relevant cases of the embryo inheritance cases abroad. At the same time, the author tries to construct me from the angle of protecting our citizens'rights reasonably. China's embryo-related legal system. Embryo is a new product of the development of science and technology in the new century. How to define the legal status of the embryo? Whether the embryo enjoys the rights of human beings or things? This issue has aroused strong controversy in various relevant fields around the world. The perfection of degree and the specification of medical supplementary technology in China will play a significant role.
