論胚胎的法律地位
[Abstract]:In 2014, China ushered in the first case of embryo inheritance, from the first instance of the embryo can not be inherited to the second instance of the two sides four couples to jointly supervise and dispose of four frozen embryos. The legal attribute of frozen embryo is a special kind of thing and belongs to a special ethical thing. It should be different from the concept of ordinary thing in inheritance and analysis orientation. However, the current law of our country has not made the correct legal status of embryo "thing". Disputes over frozen embryo inheritance will occur from time to time in the future and will not be settled promptly. The author tries to discuss the correct legal status of the embryo and the inheritance of the embryo "thing" by analyzing the concept of the object in the civil law of our country and by referring to the relevant cases of the embryo inheritance cases abroad. At the same time, the author tries to construct me from the angle of protecting our citizens'rights reasonably. China's embryo-related legal system. Embryo is a new product of the development of science and technology in the new century. How to define the legal status of the embryo? Whether the embryo enjoys the rights of human beings or things? This issue has aroused strong controversy in various relevant fields around the world. The perfection of degree and the specification of medical supplementary technology in China will play a significant role.
