【摘要】：2009年6月11日的廣州日報刊登了文章《買房買車有望獲后悔權》,彼時起后悔權這一名詞便真正進入公眾視野。據(jù)報載2008年10月《消費者權益保護法》就已列入全國人大常委會立法規(guī)劃,這意味著《消費者權益保護法》將迎來制定以來的第一次大修訂,這次大修訂中,除了擴大消費品范圍這一重點外,是否在消費者與經(jīng)營者的交易中增加消費者后悔權這一項,更是成為了如今社會上人們的關注焦點。 消費者的后悔權即無條件退貨,細看之下我國現(xiàn)有的法律在退貨方面,絕大多數(shù)是有條件退貨,只有少數(shù)幾個地區(qū)規(guī)定了無條件退貨制度,所以目前的情況是在無條件退貨方面的問題并沒有在全國范圍內(nèi)適用的法律法規(guī)。它只是體現(xiàn)在一些地方性規(guī)范或者條例中,比如上海的《上海市消費者權益保護條例》和江蘇省的《流通領域食品銷售者經(jīng)營行為規(guī)范指引》等。 相比之下,國外一些國家的后悔權制度方面的法律規(guī)定要成熟很多,所以有必要借鑒國外先進的關于后悔權的規(guī)定,結合我國在消費者退貨方面的現(xiàn)有規(guī)定和社會歷史情況來架構我國關于后悔權的制度。
[Abstract]:On June 11, 2009, Guangzhou Daily published an article entitled "the right to regret buying a house and buying a car", and since then the term "right of regret" has really come into the public eye. It has been reported that the Consumer Rights and interests Protection Law was included in the legislative plan of the standing Committee of the National people's Congress in October 2008, which means that the Law on the Protection of Consumer Rights and interests will usher in the first major revision since its enactment. Apart from expanding the scope of consumer goods, whether to increase the right of consumer regret in the transaction between consumers and operators has become the focus of attention in the society today. Consumers' right of regret is unconditional return. In terms of return, most of the existing laws in China are conditional returns. Only a few regions have stipulated an unconditional return system. So the current situation is that there are no nationwide laws and regulations applicable to unconditional returns. It is only embodied in some local norms or regulations, such as the Shanghai Municipal regulations on the Protection of consumers' Rights and interests and the Jiangsu Province's guidelines on the operational Conduct of Food sellers in the Field of Circulation, and so on. In contrast, the legal provisions on the system of regret rights in some foreign countries are much more mature, so it is necessary to learn from the advanced foreign provisions on the right to regret. Combining with the existing regulations and social historical situation of consumer return in our country, this paper constructs the system of regret right in our country.
