遠(yuǎn)程購(gòu)物消費(fèi)者后悔權(quán)制度研究

【摘要】:隨著網(wǎng)絡(luò)的發(fā)展和普及,人們的消費(fèi)方式、消費(fèi)結(jié)構(gòu)和消費(fèi)理念都發(fā)生了翻天覆地的變化,網(wǎng)絡(luò)購(gòu)物已經(jīng)成為人們生活中不可或缺的一部分。《2014年中國(guó)網(wǎng)絡(luò)購(gòu)物行業(yè)年度監(jiān)測(cè)報(bào)告》顯示,2013年度中國(guó)網(wǎng)絡(luò)購(gòu)物市場(chǎng)繼續(xù)保持快速發(fā)展的態(tài)勢(shì),全年網(wǎng)購(gòu)交易額達(dá)到1.84萬(wàn)億,同比增長(zhǎng)39.4%,在社會(huì)零售品總額中所占比例為7.9%。網(wǎng)購(gòu)給人們的生活帶來(lái)了很多方便,但網(wǎng)購(gòu)消費(fèi)者對(duì)于網(wǎng)購(gòu)的投訴卻與日俱增。所以國(guó)家對(duì)網(wǎng)購(gòu)中消費(fèi)者權(quán)益的保護(hù)非常重視,2013年4月23日的十二屆全國(guó)人大常委會(huì)審議了新《消費(fèi)者權(quán)益保護(hù)法》的草案,2014年3月15日新《消費(fèi)者權(quán)益保護(hù)法》正式實(shí)施。該法首次賦予了消費(fèi)者在非現(xiàn)場(chǎng)購(gòu)物情形下享有后悔權(quán),即“有權(quán)自收到商品之日起七日內(nèi)無(wú)理由退貨”。這顯著降低了消費(fèi)者網(wǎng)購(gòu)的風(fēng)險(xiǎn),加強(qiáng)了網(wǎng)購(gòu)中消費(fèi)者權(quán)益的保障。但是,目前新《消法》還不夠完善,在實(shí)施過(guò)程中產(chǎn)生了許多問(wèn)題。 鑒于此,文章分為四個(gè)部分進(jìn)行論述,第一部分對(duì)消費(fèi)者后悔權(quán)制度提出了一個(gè)理論界定,并分析了后悔權(quán)的特征和適用范圍;第二部分探索了我國(guó)現(xiàn)行消費(fèi)者后悔權(quán)制度實(shí)施的現(xiàn)狀及存在的主要問(wèn)題,這些問(wèn)題包括:適用范圍不明確、商品完好理解太模糊、消費(fèi)者濫用后悔權(quán)未受到限制、退回商品損壞的責(zé)任承擔(dān)未明確;第三部分采用比較分析的研究方法,介紹了德國(guó)、英國(guó)、美國(guó)以及其他國(guó)家和地區(qū)成熟的后悔權(quán)制度,并在通過(guò)比較后得出了完善我國(guó)消費(fèi)者后悔權(quán)制度的啟示,一是立法明確、建立了完備的后悔權(quán)制度體系,二是強(qiáng)化責(zé)任、處罰方式多樣化,三是廣泛動(dòng)員社會(huì)力量參與消費(fèi)者保護(hù)工作;最后一個(gè)部分采用綜合分析的研究方法,提出了完善消費(fèi)者后悔權(quán)制度的三個(gè)建議——細(xì)化條款、明確并強(qiáng)化責(zé)任追究、設(shè)立相關(guān)的配套保障制度。眾所周知,《消費(fèi)者權(quán)益保護(hù)法》的法律價(jià)值就在于最大限度的保護(hù)消費(fèi)者的合法權(quán)益,所以,建立健全消費(fèi)者后悔權(quán)這一具有傾斜保護(hù)性質(zhì)的制度,不僅能夠豐富消費(fèi)者權(quán)利類型、完善我國(guó)法律制度,而且對(duì)于切實(shí)保護(hù)消費(fèi)者合法權(quán)益、維護(hù)市場(chǎng)經(jīng)濟(jì)公平秩序等也是有百利無(wú)一害的。
[Abstract]:With the development and popularization of the network, people's consumption patterns, consumption structure and consumption concepts have undergone earth-shaking changes. Online shopping has become an indispensable part of people's lives. The annual monitoring report of China's online shopping industry in 2014 shows that China's online shopping market continued to maintain a rapid development trend in 2013, with the total value of online shopping transactions reaching 1.84 trillion in the whole year. Year-on-year growth was 39.4%, accounting for 7.9% of total social retail sales. Online shopping has brought a lot of convenience to people's lives, but online shopping consumers are increasingly complaining about online shopping. Therefore, the state attaches great importance to the protection of consumers' rights and interests in online shopping. On April 23, 2013, the standing Committee of the 12th National people's Congress considered the draft of the new Consumer Rights and interests Protection Law, which came into effect on March 15, 2014. For the first time, the law gives consumers the right to regret off-site purchases, that is, "the right to return goods without reason within seven days from the date of receipt". This significantly reduces the risk of consumer online shopping, strengthen the protection of consumer rights and interests in online shopping. However, at present, the new law is not perfect enough, and many problems have arisen in the process of implementation. In view of this, the article is divided into four parts to discuss, the first part of the consumer regret right system proposed a theoretical definition, and analyzed the characteristics of regret rights and the scope of application; The second part explores the current situation and main problems of the implementation of the current consumer regret right system in China. These problems include: the scope of application is not clear, the good understanding of goods is too vague, and the abuse of the right of regret by consumers is not restricted. The third part introduces the mature regret rights system of Germany, the United Kingdom, the United States and other countries and regions. Through comparison, the author draws the enlightenment of consummating the system of consumer's right of regret in our country. One is that the legislation is clear, the other is the establishment of a complete system of the right of regret, the second is to strengthen the responsibility, and to diversify the way of punishment. Third, mobilize social forces extensively to participate in the work of consumer protection. The last part, using the research method of comprehensive analysis, puts forward three suggestions to perfect the system of consumers' right of regret, that is, to refine the clauses, to clarify and strengthen the accountability, Establish relevant supporting safeguard system. As we all know, the legal value of the Consumer Rights and interests Protection Law lies in maximizing the protection of the legitimate rights and interests of consumers. Therefore, we should establish and improve the system of consumer repentance, which is of an inclined nature of protection. It can not only enrich the types of consumer rights, perfect our legal system, but also have no harm to protect the legitimate rights and interests of consumers and maintain the fair order of market economy.
