【摘要】：本文通過我國使用制藥用途權(quán)利要求保護(hù)醫(yī)藥用途發(fā)明的方式,深入分析了制藥用途權(quán)利要求的制定宗旨和保護(hù)本意,提取了可能影響該類型權(quán)利要求保護(hù)范圍的技術(shù)特征,并在此基礎(chǔ)上,提出了界定制藥用途權(quán)利要求保護(hù)范圍的影響因素和判斷思路。
[Abstract]:Through the way of protecting pharmaceutical invention by using pharmaceutical use rights in our country, this paper deeply analyzes the purpose and original intention of pharmaceutical use claims, and extracts the technical characteristics that may affect the scope of protection of this type of claims. On the basis of this, the paper puts forward the influence factors and judgment ideas to define the scope of pharmaceutical use rights protection.
