【摘要】：根據(jù)我國《憲法》第9條,自然資源屬于國家所有即全民所有。從國家所有權(quán)性質(zhì)、立法原意以及行使實踐角度解釋,"國家所有"與"全民所有"具有本質(zhì)上的一致性和統(tǒng)一性�！段餀�(quán)法》等法律規(guī)定以國家名義享有全民所有權(quán),不僅具有堅實的法理基礎(chǔ),而且符合全民表達共同意志和維護公共利益的制度性要求。健全自然資源國家所有權(quán)制度,首先必須從理念上重視國家所有權(quán)主體全民性的意義,從制度和程序上保障全民真正享有自然資源國家所有權(quán)。通過全國人民代表大會這一民主制度和程序,可以將全民共同意志和利益反映并體現(xiàn)到自然資源國家所有權(quán)的建構(gòu)和行使中,保障和實現(xiàn)國家所有與全民所有的一致性和統(tǒng)一性�？梢栽谌嗣翊泶髸贫瓤蚣芟�,建立自然資源國家所有權(quán)行使的民主程序機制,保障全民能夠通過這一機制表達共同意志,并監(jiān)督國務(wù)院切實代表全民公共利益行使國家所有權(quán),真正實現(xiàn)"國家所有"即"全民所有"的立法價值和目的。
[Abstract]:According to Article 9 of our Constitution, natural resources are owned by the state and the whole people. In terms of the nature of state ownership, the legislative intent and the exercise of practice, "state ownership" and "universal ownership" are intrinsically consistent and unified. Not only has a solid legal basis, but also conforms to the common will of the whole people and safeguard the public interest. In order to perfect the national ownership system of natural resources, we must first attach importance to the meaning of the national ownership subject and guarantee the whole people's real ownership of natural resources in terms of system and procedure. Through the democratic system and procedures of the National people's Congress, the common will and interests of the whole people can be reflected and reflected in the construction and exercise of state ownership of natural resources, To guarantee and realize the consistency and unity between state ownership and national ownership. A democratic procedural mechanism for the exercise of state ownership of natural resources can be established within the framework of the system of the people's Congress, through which the common will of the whole people can be guaranteed. It also supervises the State Council to exercise state ownership on behalf of the public interest of the whole people and to realize the legislative value and purpose of "national ownership", that is, "national ownership".
