【摘要】：近年來,業(yè)主與物業(yè)服務(wù)企業(yè)之間的摩擦不斷,隨之而來的物業(yè)服務(wù)合同糾紛呈逐年上漲的趨勢。物業(yè)服務(wù)合同是業(yè)主在物業(yè)服務(wù)合同糾紛中行使抗辯權(quán)的主要依據(jù)。業(yè)主抗辯權(quán)的正當(dāng)行使有利于維護物業(yè)關(guān)系的穩(wěn)定,促進市場經(jīng)濟秩序的健康發(fā)展。物業(yè)服務(wù)合同主要包括前期物業(yè)服務(wù)合同和普通的物業(yè)服務(wù)合同,這兩類合同雖然在簽訂主體有所不同,但都是業(yè)主行使抗辯權(quán)的依據(jù)。同時,物業(yè)服務(wù)的持續(xù)性和不計量性特點決定了業(yè)主抗辯權(quán)不同于普通雙務(wù)合同履行中的抗辯權(quán),它的類型主要為同時履行抗辯權(quán)和不安抗辯權(quán)。雖然物業(yè)服務(wù)合同糾紛層出不窮,但通過親自經(jīng)歷此類案件的審判實踐,發(fā)現(xiàn)業(yè)主行使抗辯權(quán)的事由較為集中,這為研究業(yè)主抗辯權(quán)的現(xiàn)狀提供了思路。本文重點結(jié)合物業(yè)服務(wù)合同糾紛具體案例,對業(yè)主在行使抗辯權(quán)過程中所存在的制度問題進行探討,提出完善的意見和建議。筆者以B市某法院的六個案例為實證分析素材,根據(jù)業(yè)主行使抗辯權(quán)事由的不同對素材做分類并逐一探討,通過分析業(yè)主抗辯權(quán)行使的現(xiàn)狀,引發(fā)對當(dāng)前制度的思考。在制度的完善上,立法制度方面,應(yīng)盡快完善建設(shè)單位選聘物業(yè)服務(wù)企業(yè)制度,明確物業(yè)服務(wù)企業(yè)安全保障義務(wù)的范圍、“業(yè)主”的范圍、物業(yè)服務(wù)企業(yè)的服務(wù)標(biāo)準(zhǔn);司法制度方面,應(yīng)合理分配業(yè)主與物業(yè)服務(wù)企業(yè)之間的舉證責(zé)任,同時也要完善物業(yè)服務(wù)合同糾紛解決機制。
[Abstract]:In recent years, the frictions between the owners and the property service enterprises have continued, and the concomitant disputes on the property service contract have been rising year by year. The property service contract is the main basis for the owners to make the right of defense in the disputes of the property service contract. The proper exercise of the right of defense of the owners is beneficial to the maintenance of the stability of the property relations and the promotion of the market economy. The property service contract mainly includes the early property service contract and the common property service contract. Although the two types of contracts are different in the signing subject, they are the basis for the owners to exercise the right of defense. At the same time, the continuity and the non measurement of the property service decide that the right of defense of the owner is different from the common double contract. The right of defense in the line is mainly to perform the right of defense and the right of displea. Although the disputes of the property service contract emerge in an endless stream, through the trial practice of this kind of case, it is found that the owner is more concentrated in the exercise of the right of defense. This provides a way of thinking for the study of the current situation of the right of defense of the owners. In the case of service contract disputes, the author probes into the institutional problems existing in the process of exercising the right of defense of the owners, and puts forward the perfect opinions and suggestions. The author takes six cases of a court of B as an empirical analysis material, classifies and discusses the material according to the differences of the owner's right to exercise the right of defense, and analyzes the right of defense of the owner by analyzing the rights of the owner. In the perfection of the system and the legislative system, we should improve the system of the establishment of the property service enterprise as soon as possible, clear the scope of the security obligations of the property service enterprises, the scope of the owners, the service standards of the property service enterprises, and the rational distribution of the proprietors and the judicial system. The burden of proof between property service enterprises and the dispute settlement mechanism of property service contracts should also be improved.
