【摘要】：對于知識產(chǎn)權(quán)的性質(zhì),法國立法和司法活動中呈現(xiàn)出觀點分歧,原因在于知識產(chǎn)權(quán)與所有權(quán)的性質(zhì)存在差異,而無法將知識產(chǎn)權(quán)簡單地歸類于法國法所定義的所有權(quán)。法國學界通過對所有權(quán)定義的擴展,將知識產(chǎn)權(quán)定義為一種財產(chǎn)權(quán)利,并且知識產(chǎn)權(quán)的特殊性決定了必須適用特殊的知識產(chǎn)權(quán)法律制度。
[Abstract]:There are different views on the nature of intellectual property in French legislation and judicial activities, because the nature of intellectual property is different from that of ownership, and it is impossible to categorize intellectual property simply under the definition of ownership in French law. French scholars define intellectual property as a kind of property right through the extension of the definition of ownership, and the particularity of intellectual property determines that special intellectual property legal system must be applied.
