【摘要】：從當前學(xué)生傷害事故的司法判例對學(xué)生傷害事故處理的法律依據(jù)、責任承擔比例及賠償和法院裁量的理由進行分析,以加強學(xué)校及教師對學(xué)生傷害事故的法律認識,明晰學(xué)校責任,合理賠償,進而提高學(xué)校預(yù)防學(xué)生傷害事故的水平和能力,進而保障學(xué)生安全,維護學(xué)校的合法權(quán)益。
[Abstract]:This paper analyzes the legal basis of dealing with student injury accident, the proportion of responsibility and the reason of compensation and court discretion from the current judicial precedents of student injury accident, in order to strengthen the legal understanding of students' injury accident in schools and teachers. Clear school responsibility, reasonable compensation, and then improve the level and ability of the school to prevent injury accidents, and then ensure the safety of students, safeguard the legitimate rights and interests of the school.
