論我國網(wǎng)購消費者后悔權(quán)制度的完善

【摘要】:消費者后悔權(quán)是指消費者與經(jīng)營者雙方訂立了買賣合同之后,按照法律的相關(guān)規(guī)定,在一定的時間段里消費者享有的自主決定與經(jīng)營者之間的合同恢復(fù)到尚未訂立之時的狀態(tài),而且消費者不用向經(jīng)營者說明理由,也不用因此承擔(dān)賠償或者是補償責(zé)任。因為該權(quán)利并非是我國土生土長的法律,所以該制度在我國的出現(xiàn)和發(fā)展過程中勢必會出現(xiàn)一些問題,尤其是在當(dāng)下這個網(wǎng)絡(luò)購物如此普及的時代,因此對于消費者在遠程購物當(dāng)中可能會出現(xiàn)的問題值得討論和進一步的研究。本文分為四章來論述我國網(wǎng)購消費者后悔權(quán)制度的完善,第一章是網(wǎng)購消費者后悔權(quán)制度的概述,通過與《合同法》中的撤銷權(quán)以及解除權(quán)做比較,進一步的突出消費者后悔權(quán)的特征:單方性、法定性和無因性。第二章是介紹域外關(guān)于消費者后悔權(quán)制度的相關(guān)規(guī)定,主要是介紹英國、美國和德國這三個發(fā)達國家在消費者后悔權(quán)制度的起算點、權(quán)利的行使期限、行使的法律后果等。第三章是我國消費者后悔權(quán)制度的現(xiàn)狀及存在的問題,首先,介紹了我國消費者后悔權(quán)制度的發(fā)展過程,其次分析我國消費者后悔權(quán)制度設(shè)計的合理性,最后通過與第二章介紹的發(fā)達國家的相關(guān)規(guī)定,比較得出我國消費者后悔權(quán)制度存在的問題。第四章是我國消費者后悔權(quán)制度的完善,對于域外的相關(guān)規(guī)定進行借鑒基礎(chǔ)上提出了進一步完善的建議:完善相關(guān)法律制度,適用范圍進一步擴大,將服務(wù)納入消費者后悔權(quán)制度,完善權(quán)利的行使期間,將權(quán)利的起算點與經(jīng)營者的告知義務(wù)相掛鉤;加大監(jiān)管的力度,加強行業(yè)和行政的監(jiān)管;健全司法救濟機制,發(fā)展在線糾紛解決機制,提高辦事的效率;加大法治宣傳教育,使得消費者真正的學(xué)會運用法律來保護自己的權(quán)利同時也要規(guī)范自己的行為。
[Abstract]:The right of consumer repentance refers to the state in which the contract between the consumer and the operator is restored to the time when the contract between the consumer and the operator has not been concluded in accordance with the relevant provisions of the law, and the contract between the consumer and the operator is restored to a certain period of time after the conclusion of the contract. And consumers do not have to explain reasons to the operator, do not assume compensation or liability for compensation. Because this right is not a native law of our country, there are bound to be some problems in the emergence and development of this system in our country, especially in the current era when online shopping is so popular. Therefore, it is worth discussing and further studying the problems that the consumers may appear in the distance shopping. This paper is divided into four chapters to discuss the perfection of the system of repentance right of online shopping consumers in our country. The first chapter is an overview of the system of repentance right of online shopping consumers, which is compared with the revocation right and rescission right in contract Law. Further highlight the characteristics of consumer rights of regret: unilateral, legal and non-cause. The second chapter is to introduce the relevant provisions of the system of consumer repentance, mainly introduces the UK, the United States and Germany, the three developed countries in the consumer regret system of the starting point, the exercise of rights, the legal consequences of the exercise. The third chapter is the current situation and existing problems of the consumer regret right system in our country. Firstly, it introduces the development process of the consumer regret right system in our country, and then analyzes the rationality of the design of the consumer regret right system in our country. Finally, by comparing with the relevant regulations of developed countries introduced in the second chapter, the author draws the conclusion that there are problems in the system of consumer repentance in our country. The fourth chapter is the consummation of the system of consumer's right of regret in our country. On the basis of reference to the relevant provisions of foreign countries, the author puts forward some suggestions: to perfect the relevant legal system, to expand the scope of application, Bring the service into the consumer repentance system, perfect the exercise of the right, link the starting point of the right with the operator's duty of informing, strengthen the supervision, strengthen the supervision of the industry and administration, perfect the judicial relief mechanism, Develop online dispute resolution mechanism to improve the efficiency of work; increase the rule of law publicity and education, so that consumers really learn to use the law to protect their rights, but also to regulate their own behavior.
