【摘要】：隨著科學(xué)技術(shù)的不斷進(jìn)步,社會經(jīng)濟(jì)的高速發(fā)展,人類社會文明不斷前進(jìn),但同時環(huán)境也日趨惡化,逐漸成為了引起社會普遍關(guān)注的全球性的問題。在對環(huán)境問題尋求解決方案的探索中,綠色技術(shù)的創(chuàng)新和運(yùn)用無疑是解決這一問題最根本手段,此時與綠色技術(shù)創(chuàng)新與運(yùn)用關(guān)系最為緊密的知識產(chǎn)權(quán)特別是專利制度在有效發(fā)揮其鼓勵技術(shù)創(chuàng)新、促進(jìn)技術(shù)傳播與運(yùn)用方面的作用愈發(fā)的顯現(xiàn)出來。在此背景下,為了更好地應(yīng)對環(huán)境問題帶來的巨大挑戰(zhàn),我國應(yīng)該立足本國國情和現(xiàn)實(shí)狀況,并借鑒國外相關(guān)立法與實(shí)踐,構(gòu)建一套有益于環(huán)境、操作性強(qiáng)的綠色專利制度,以實(shí)現(xiàn)環(huán)境、經(jīng)濟(jì)和社會的和諧發(fā)展。 本文作者研究發(fā)現(xiàn),國外一些國家早已意識到了環(huán)境問題帶來的挑戰(zhàn),紛紛開始采取一系列有關(guān)綠色專利的立法和政策措施,以達(dá)到鼓勵、促進(jìn)綠色技術(shù)創(chuàng)新與運(yùn)用的目的,在解決環(huán)境問題的同時,也開始搶占綠色技術(shù)方面的制高點(diǎn),不斷增強(qiáng)國際競爭力。 本文主要對有益于構(gòu)建我國綠色專利制度的有關(guān)國際公約,如：巴黎公約、TRIPS協(xié)定等進(jìn)行評析,以及對英國、美國等一些國家的相關(guān)立法與實(shí)踐進(jìn)行探討,總結(jié)經(jīng)驗(yàn)、教訓(xùn),立足我國國情,以上述國際經(jīng)驗(yàn)、教訓(xùn)為借鑒研究背景,并對我國相關(guān)立法及實(shí)踐狀況進(jìn)行分析研究,在此基礎(chǔ)上進(jìn)而對構(gòu)建我國綠色專利制度提出具體建議。
[Abstract]:With the continuous progress of science and technology and the rapid development of social economy, human social civilization is advancing constantly, but at the same time, the environment is deteriorating day by day, which has gradually become a global problem that has aroused the universal attention of the society. In the search for solutions to environmental problems, the innovation and application of green technologies are undoubtedly the most fundamental means to solve this problem. At this time, the most closely related to the green technology innovation and application of intellectual property rights, especially the patent system to effectively play its role in encouraging technological innovation, promoting technology dissemination and use of the role of increasingly apparent. Under this background, in order to better deal with the huge challenge brought by the environmental problem, our country should base on the national conditions and the actual situation, and draw lessons from the relevant legislation and practice of foreign countries, and construct a set of green patent system which is beneficial to the environment and has strong operability. To realize the harmonious development of environment, economy and society. The author of this paper finds that some foreign countries have already realized the challenge brought by environmental problems, and have begun to adopt a series of legislation and policy measures on green patents to encourage and promote the innovation and application of green technology. At the same time to solve environmental problems, but also began to seize the commanding heights of green technology, constantly enhance international competitiveness. This paper mainly analyzes the relevant international conventions, such as the Paris Convention and trips Agreement, which are beneficial to the construction of China's green patent system, and probes into the relevant legislation and practice of some countries, such as Britain, the United States, etc., and summarizes the experiences and lessons learned. Based on the national conditions of our country, taking the above international experience and lessons as the reference background, and analyzing the relevant legislation and practice of our country, this paper puts forward some concrete suggestions on the construction of the green patent system in our country.
