【摘要】：隨著我國(guó)社會(huì)老齡化程度的加深,養(yǎng)老已經(jīng)成為社會(huì)公眾普遍關(guān)注的話題。在人口老齡化和家庭養(yǎng)老功能日漸衰退的雙重壓力下,入住養(yǎng)老機(jī)構(gòu)成為老年人安度晚年的合適選擇。由于相關(guān)法律規(guī)定的不完善,入住老人受傷后,雙方當(dāng)事人經(jīng)常為誰承擔(dān)賠償責(zé)任引發(fā)糾紛。這樣不僅入住老人的合法權(quán)益得不到保障,而且高額頻繁的賠償也使養(yǎng)老機(jī)構(gòu)不堪重負(fù)。因此,入住老人在養(yǎng)老機(jī)構(gòu)中出現(xiàn)傷害事故該如何解決、責(zé)任該如何劃分成了刻不容緩的問題。本文通過實(shí)證研究,運(yùn)用案例分析的方法,按照提出問題、分析問題和解決問題的思路,對(duì)養(yǎng)老機(jī)構(gòu)內(nèi)入住老人傷害事故法律責(zé)任承擔(dān)的問題提出了自己的思考。本文正文共分三個(gè)部分：第一部分：提出問題。通過介紹案例說明養(yǎng)老機(jī)構(gòu)中目前存在的問題——入住老人家屬與養(yǎng)老機(jī)構(gòu)糾紛多發(fā)。第二部分：分析問題。這部分是對(duì)“當(dāng)事人糾紛多發(fā)”的原因分析。當(dāng)事人糾紛不斷的實(shí)質(zhì)是養(yǎng)老機(jī)構(gòu)內(nèi)入住老人傷害事故法律責(zé)任認(rèn)定不清,這一方面是由資金不足、養(yǎng)老機(jī)構(gòu)設(shè)備及服務(wù)不完善等現(xiàn)實(shí)條件所致,另一根本原因是雙方當(dāng)事人的法律關(guān)系不明確和雙方認(rèn)定責(zé)任依據(jù)不清。第三部分：解決問題。對(duì)于入住老人傷害事故法律責(zé)任承擔(dān)問題,筆者從法理和現(xiàn)實(shí)中來尋求解決的辦法,一方面希望有更加合理的歸責(zé)原則和認(rèn)定責(zé)任主體的方式來指導(dǎo)具體的實(shí)踐；另一方面從法律法規(guī)的制定、養(yǎng)老機(jī)構(gòu)的法律責(zé)任承擔(dān)、入住老人與養(yǎng)老機(jī)構(gòu)格式合同的制定、風(fēng)險(xiǎn)渠道的構(gòu)建等多個(gè)角度來預(yù)防及減少入住老人與養(yǎng)老機(jī)構(gòu)的糾紛�？傊�,本文通過對(duì)養(yǎng)老機(jī)構(gòu)內(nèi)入住老人傷害事故責(zé)任承擔(dān)的案例分析,指出我國(guó)養(yǎng)老機(jī)構(gòu)存在的問題,并提出法律責(zé)任認(rèn)定和糾紛緩解的對(duì)策,期望本文的研究可以為養(yǎng)老機(jī)構(gòu)的發(fā)展提供一個(gè)良好的社會(huì)氛圍,也希望我國(guó)的養(yǎng)老服務(wù)業(yè)可以邁進(jìn)新階段。
[Abstract]:With the deepening of the aging of our society, pension has become a common concern of the public. Under the double pressure of aging population and declining family pension function, it is a suitable choice for the elderly to stay in the old age. Due to the imperfections of relevant laws and regulations, after the elderly are injured, the two parties often take the responsibility of compensation and lead to disputes. In this way, the legal rights and interests of the elderly can not be guaranteed, and the high and frequent compensation also makes the pension institutions overburdened. Therefore, the problem of how to solve the injury accident and how to divide the responsibility in the old-age care institution is urgent. Based on the empirical research and case study, this paper puts forward my own thinking on the legal responsibility of the elderly injury accident in the old-age care institutions according to the ideas of putting forward the problems, analyzing the problems and solving the problems. This text is divided into three parts: the first part: put forward the question. Through the introduction of cases to illustrate the existing problems in pension institutions-the elderly family members and pension institutions more disputes. Part two: analysis of problems. This part is an analysis of the causes of the frequent disputes between the parties. The essence of the dispute between the parties is that the legal liability of the elderly injury accident in the pension institutions is not clear, which is caused by the lack of funds, the imperfect equipment and services of the pension institutions, and other practical conditions. Another fundamental reason is that the legal relationship of both parties is unclear and the basis of both parties' determination of responsibility is unclear. The third part: solve the problem. On the one hand, I hope that there are more reasonable principles of imputation and the way to identify the main body of responsibility to guide the specific practice. On the other hand, it can prevent and reduce the disputes between the elderly and the old-age institutions from the formulation of laws and regulations, the legal responsibility of the pension institutions, the establishment of the contract between the elderly and the pension institutions, the construction of risk channels and so on. In a word, this paper points out the problems existing in the old-age care institutions and puts forward the countermeasures of legal liability determination and dispute mitigation through the case analysis on the responsibility of the elderly injury accidents in the pension institutions, and points out the problems existing in the old-age care institutions in our country. It is expected that the research in this paper can provide a good social atmosphere for the development of pension institutions, and also hope that China's pension service industry can enter a new stage.
