【摘要】：云計算擁有十分強大的運算能力,它能在十分高效的情況下同時處理龐雜的數(shù)據(jù),它最大的優(yōu)勢就是把保存在各種設(shè)備上的龐雜的資料與處理器自身的信息匯集起來,并組織它們共同發(fā)揮作用,以便于該平臺的所有用戶都能對其進行使用。不管你處于什么位置,也不管是白天還是晚上,所有用戶都可以簡單快捷的和網(wǎng)絡(luò)終端進行很好的連接,利用云計算技術(shù)這項服務(wù),能夠輕松的達成對各種多樣的資源進行使用的目的。因此可以說,云計算技術(shù)是一項具有巨大潛力的產(chǎn)業(yè),它打破以往慣常的作品的傳播方式,而是為其提供了一種新的實踐性,這一具有重大意義的變化將大大改變了人們的交流方式以及作品的生產(chǎn)和傳播方式,但任何事情都是有利有弊的,云計算技術(shù)同時也帶來了一些問題,本文要提到的就是其給著作權(quán)法帶來的新的弊端以及相關(guān)的解決辦法。本文從云計算對版權(quán)保護的影響著手,通過對國內(nèi)外典型案例的分析,為我國在云計算環(huán)境下應(yīng)如何構(gòu)建完善的版權(quán)保護制度提出了相應(yīng)的建議。本文共分5章。第1章是緒論部分,講述了選題的背景和意義,對當前研究進行了文獻綜述并得出了論點。第2章界定了云計算的概念,介紹了云計算環(huán)境下版權(quán)的新特征。第3章對國內(nèi)外典型案例進行了深度剖析,以期從這幾個案例中,更深一步的闡釋技術(shù)發(fā)展與法律規(guī)定之間的不一致的問題。第4章聚焦云計算技術(shù)對版權(quán)的沖擊,論述云環(huán)境下版權(quán)所面臨的挑戰(zhàn)。如臨時復制的界定問題、避風港原則的適用問題、電子取證難度加大的問題等。第5章對云計算環(huán)境下出現(xiàn)的版權(quán)保護新問題提出了相關(guān)建議。
[Abstract]:Cloud computing has a very powerful computing power that can handle complex data at the same time in a very efficient way. Its greatest advantage is to gather the complex information stored on all kinds of devices and the information of the processor itself, and organize them to work together so that all users of the platform can do it. No matter where you are, whether you are in the daytime or at night, all users can easily and quickly connect with the network terminal. Using cloud computing technology can easily achieve the purpose of using all kinds of resources. So, it can be said that cloud computing is a great potential. The industry, which breaks the usual mode of transmission of the usual works, provides a new practice for it. This significant change will greatly change the way people communicate and the mode of production and dissemination of their works. But all things are both pros and cons, and the cloud computing technology also brings some problems. We should mention the new drawbacks and relevant solutions to the copyright law. This article begins with the influence of cloud computing on copyright protection. Through the analysis of typical cases at home and abroad, this paper puts forward some suggestions on how to build a perfect copyright protection system in the cloud computing environment. This paper is divided into 5 chapters. The first chapter is The introduction part, narrated the background and significance of the topic, reviewed the current research and got the argument. The second chapter defined the concept of cloud computing, introduced the new characteristics of copyright under the cloud computing environment. The third chapter made a deep analysis of the typical cases at home and abroad, in order to further explain the development of the technology from these cases. In the fourth chapter, the impact of polyfocal cloud computing technology on copyright is discussed, and the challenges facing copyright under the cloud environment are discussed, such as the definition of the temporary copy, the application of the principle of the harbor, the problem of the difficulty in electronic forensics, and so on. The fifth chapter puts forward the new problems of copyright protection in the environment of cloud calculation. Relevant suggestions.
