【摘要】：一般認(rèn)為,在地權(quán)糾紛中,"戶籍"是集體成員權(quán)身份和資格認(rèn)定的唯一核心要素。然而,事實(shí)并非如此。通過對東北林權(quán)改革中,村級合并、戶籍回遷和"外嫁女"土地權(quán)益三類案例的考察,發(fā)現(xiàn)地權(quán)的內(nèi)涵與其說是集體成員權(quán)的展現(xiàn),還不如說是村落成員權(quán)的表達(dá)。實(shí)踐中的集體成員權(quán)表達(dá)了村民對社區(qū)財(cái)產(chǎn)邊界、共同體成員和倫理身份的認(rèn)同,實(shí)際上展現(xiàn)的是一種村落成員權(quán)�；谘壓偷鼐�,村落成員權(quán)具有排他性、獨(dú)占性、人格化和繼替性特征。它具體呈現(xiàn)了社區(qū)內(nèi)部共享的文化價值、社群網(wǎng)絡(luò)、互助體系和互惠模式,具有內(nèi)在的封閉性和保護(hù)性,是村落共同體存在的一種表現(xiàn)。
[Abstract]:It is generally believed that in land ownership disputes, household registration is the only core element of collective membership status and qualification. However, this is not the case. Through the investigation of three kinds of cases in the reform of forest property right in Northeast China, such as village merger, the return of household registration and the land rights and interests of "married women outside", it is found that the connotation of land rights is not so much the expression of collective membership rights as the expression of village members' rights. The collective membership rights in practice express the villagers' recognition of community property boundaries, community members and ethical identities, and in fact show a kind of village membership rights. Based on consanguinity and geography, village membership has the characteristics of exclusiveness, exclusiveness, personification and succession. It presents the cultural value of community sharing, social network, mutual aid system and mutual benefit model, which has the inherent closeness and protection, which is a manifestation of the village community.
