【摘要】：近年來,以仿造和不遵守道德或法律準(zhǔn)則為特征的山寨文化,因?yàn)橹R(shí)產(chǎn)權(quán)問題而飽受爭議,從而引發(fā)了知識(shí)產(chǎn)權(quán)管理界的關(guān)注。其中,山寨文化對(duì)當(dāng)代經(jīng)濟(jì)和社會(huì)生活帶來了哪些影響,如何正確認(rèn)識(shí)山寨文化及其存在的問題等,成為了管理者關(guān)注的焦點(diǎn)。本文從知識(shí)產(chǎn)權(quán)創(chuàng)造、運(yùn)用、管理和保護(hù)四個(gè)維度,運(yùn)用知識(shí)產(chǎn)權(quán)管理理論,采用案例分析、走訪訪談、統(tǒng)計(jì)分析等方法對(duì)山寨文化中主要的知識(shí)產(chǎn)權(quán)問題進(jìn)行研究。本文認(rèn)為,從山寨文化的本質(zhì)看,“山寨”廣泛存在,并不是中國的專利,但其存在與發(fā)展仍然凸現(xiàn)了我國知識(shí)產(chǎn)權(quán)體制的不足。對(duì)山寨文化我們應(yīng)該有一個(gè)科學(xué)的認(rèn)知：既不應(yīng)全盤否定,也不能放任自流,應(yīng)該通過積極的引導(dǎo),規(guī)范山寨文化健康發(fā)展；同時(shí),完善知識(shí)產(chǎn)權(quán)制度,大力倡導(dǎo)知識(shí)產(chǎn)權(quán)文化,讓山寨文化成為一種新型的創(chuàng)業(yè)文化,逐步成為知識(shí)產(chǎn)權(quán)文化的一部分。
[Abstract]:In recent years, copycat culture, characterized by imitation and failure to abide by moral or legal norms, has been controversial because of intellectual property issues, which has aroused the attention of intellectual property management.Among them, what influence Shanzhai culture has brought to contemporary economic and social life, how to correctly understand shanzhai culture and its existing problems has become the focus of attention of managers.From the four dimensions of intellectual property creation, application, management and protection, this paper uses the theory of intellectual property management, case analysis, interview, statistical analysis and other methods to study the main intellectual property issues in Shanzhai culture.From the essence of shanzhai culture, the existence and development of shanzhai is not the patent of China, but its existence and development still highlight the shortcomings of our intellectual property system.We should have a scientific understanding of shanzhai culture: neither should we completely deny it, nor should we let it go. We should standardize the healthy development of the Shanzhai culture through positive guidance; at the same time, we should improve the intellectual property system.Advocate intellectual property culture vigorously, let Shanzhai culture become a new type of pioneering culture, gradually become a part of intellectual property culture.
