【摘要】：研究目的:通過(guò)比較分析,揭示基于物權(quán)路徑引入發(fā)展權(quán)之不可行性,以期為發(fā)展權(quán)本土化研究路徑的改進(jìn)提供思路。研究方法:比較分析法,文獻(xiàn)分析法。研究結(jié)果:在立法技術(shù)層面,根植于產(chǎn)權(quán)范式的發(fā)展權(quán),不具備物權(quán)客體之要件,并與物權(quán)法定和所有權(quán)單一性原則相沖突。在法律邏輯層面,TDR實(shí)施的個(gè)案性與物權(quán)的對(duì)世性相矛盾,所引證的雙重所有權(quán)理論和英國(guó)發(fā)展權(quán)國(guó)有化的規(guī)定失之于偏頗,土地用途管制是國(guó)家行使規(guī)劃?rùn)?quán)而非發(fā)展權(quán)的結(jié)果,試圖藉由地方性法規(guī)創(chuàng)設(shè)發(fā)展權(quán)的思路也不符合《立法法》之規(guī)定。研究結(jié)論:基于物權(quán)路徑引入發(fā)展權(quán)是不可行的,未來(lái)應(yīng)拋棄"機(jī)械式"移植觀(guān),沿著準(zhǔn)物權(quán)和提高管制效率的方向,探索引入發(fā)展權(quán)的可能路徑與方案。
[Abstract]:The purpose of this paper is to reveal the infeasibility of introducing the right to development based on the path of real right through comparative analysis in order to provide a way to improve the localization of the right to development.Methods: comparative analysis, literature analysis.The research result: at the legislative technical level, the right to development rooted in the paradigm of property right does not possess the elements of the object of real right, and conflicts with the principle of property law and the principle of the singularity of ownership.In the aspect of legal logic, the case of TDR is inconsistent with the universal nature of real right, and the theory of dual ownership and the nationalization of the right to development in Britain are biased. The land use control is the result of the country exercising the right to plan rather than the right to development.The idea of trying to create the right to development by means of local laws and regulations is also inconsistent with the provisions of the Legislative Law.The conclusion is that it is not feasible to introduce the right to development based on the path of real right. In the future, we should abandon the concept of "mechanical" transplantation and explore the possible path and scheme of introducing the right to development along the direction of quasi-real right and improving the efficiency of control.
