【摘要】：在傳統(tǒng)的人格權(quán)理論中,人身專屬性和非財(cái)產(chǎn)性是人格權(quán)的兩個(gè)基本特征,因此針對(duì)侵權(quán)行為只涉及精神損害賠償。但是當(dāng)社會(huì)經(jīng)濟(jì)水平發(fā)展至一定階段,人格權(quán)商業(yè)利用范圍得到極大的擴(kuò)展,姓名權(quán)、名譽(yù)權(quán)等人格要素開始具備財(cái)產(chǎn)價(jià)值。然而,受傳統(tǒng)人格權(quán)觀念影響頗深的司法實(shí)踐仍不承認(rèn)人格權(quán)所具備的財(cái)產(chǎn)價(jià)值。即便有些承認(rèn)人格權(quán)的財(cái)產(chǎn)價(jià)值,但在具體的保護(hù)實(shí)踐當(dāng)中依舊存在法理依據(jù)不清晰等問題。本文從梳理人格與人格權(quán)的發(fā)展歷程入手,在回顧中逐步揭示了人格以及人格權(quán)理論在不斷發(fā)展的歷程中所展現(xiàn)的開放性的特征,這一重要特征的發(fā)現(xiàn)從理論上證明了人格權(quán)理論可以作出調(diào)整以適應(yīng)人格需要的可行性。從而,筆者提出在人格要素的商業(yè)利用實(shí)踐中,對(duì)于不能夠?qū)ζ涮峁┯行ПＷo(hù)的人格權(quán)理論以及司法實(shí)踐也亟需作出調(diào)整。文章回顧了人格權(quán)和財(cái)產(chǎn)權(quán)之間的關(guān)系發(fā)展史,展示了二者從混同到分離再到融合的發(fā)展歷程。在此基礎(chǔ)上,筆者闡釋了自然人人格要素具備人格權(quán)屬性,標(biāo)表型人格權(quán)具備財(cái)產(chǎn)權(quán)屬性,在人格要素的商業(yè)利用實(shí)踐中處分的是其人格權(quán),利用的是其人格權(quán)利益等問題。文章對(duì)上述問題的一系列探討對(duì)于研究人格權(quán)經(jīng)濟(jì)利益的相關(guān)問題打下了堅(jiān)實(shí)的理論基礎(chǔ)。
[Abstract]:In the traditional theory of right of personality, personal attributes and non property are two basic characteristics of the right of personality, so for the infringement relates only to spiritual damages. But when the level of socio-economic development to a certain stage, the commercial use of personality right to extend greatly the range, the right of name, reputation and other personality factors with the value of the property. However, the value of judicial practice which is deeply influenced by the traditional concept of personality right still does not recognize the right of personality has the property value. Even if some admit the right of personality and property, but in practice still protect the problems existing in the legal basis is not clear. This article from the development process of combing personality and personality right firstly, in retrospect gradually reveals the personality characteristics and open personality theory show in the course of development in the discovery of this important feature is proved from the theory of personality The theory of the right adjustments can be made to adapt to the feasibility of personality needs. Thus, the author puts forward the personality factors of commercial use in practice, for the personality theory can't provide effective protection to the judicial practice and also need to be adjusted. This paper reviews the development history of the relationship between personality right and property right, the two from the show confused to separation and to the development of fusion. On this basis, the author explains the elements of the personality of natural person have the property right of personality, individual personality rights have the property rights, the commercial use of personality factors in practice. The personality right is the use of their human rights problems. Based on the above interests the problem of a series of discussions on issues related to the economic interests of the right of personality to lay a solid theoretical foundation.
