【摘要】：由于人格權(quán)的禁止轉(zhuǎn)讓,人格要素的商業(yè)化利用只能采取權(quán)利人"同意"或許可使用的方式,它僅具有債權(quán)的效力,不符合現(xiàn)代社會(huì)對(duì)人格要素使用的要求。物權(quán)法上的創(chuàng)設(shè)定限物權(quán)的權(quán)能分離理論,對(duì)人格權(quán)的商業(yè)化利用具有借鑒價(jià)值:借助科學(xué)技術(shù),人格要素的商業(yè)使用具有"客體化"的可能,人格權(quán)包含了積極的使用、收益權(quán)能,且人格權(quán)與所有權(quán)同為支配權(quán)。商品化人格權(quán)的定限轉(zhuǎn)讓,創(chuàng)設(shè)了一個(gè)具有物權(quán)性質(zhì)的人格權(quán)使用權(quán);它的內(nèi)容主要根據(jù)當(dāng)事人的意思自治決定,因?yàn)榫哂刑囟ǖ墓拘?人格權(quán)使用權(quán)并不會(huì)造成對(duì)第三人自由的過(guò)分限制。
[Abstract]:Due to the prohibition of the transfer of personality rights, the commercial use of personality elements can only be "agreed" or permitted by the obligee. It only has the effect of creditor's rights and does not meet the requirements of modern society for the use of personality elements.The theory of the separation of power and power in the creation and limitation of real right in real right law has reference value for the commercial use of personality right: with the aid of science and technology, the commercial use of personality elements has the possibility of "objectification", and personality right includes positive use.Income right can, and the personality right and the ownership right are the dominating right.The limited transfer of commercialized personality right creates a right of use of personality right with the nature of real right, the content of which is mainly determined according to the autonomy of the parties, because of its specific publicity,
