【摘要】：《侵權(quán)責(zé)任法》第20條所規(guī)定的獲利返還請求權(quán)實(shí)施以來,法官酌定在獲利返還請求權(quán)中得到了廣泛運(yùn)用,但由此也產(chǎn)生了法官自由裁量權(quán)過大、影響侵權(quán)法損害預(yù)防功能實(shí)現(xiàn)等弊端。為了更好地發(fā)揮法官酌定的作用,應(yīng)當(dāng)明確獲利返還的適用條件、明確法官酌定時應(yīng)當(dāng)考慮的因素,同時,完善相關(guān)立法,規(guī)定明確的、具有可操作的損害計(jì)算標(biāo)準(zhǔn),如在一定情形下可以考慮使用擬制許可使用費(fèi)標(biāo)準(zhǔn)等,以有效規(guī)范法官酌定權(quán)的行使。
[Abstract]:Since the implementation of the right of claim for return of profits stipulated in Article 20 of the Tort liability Law, the discretion of the judge has been widely used in the claim for return of profits, but this has also resulted in the excessive discretion of the judge. In order to play the role of judge's discretion better, it is necessary to make clear the applicable conditions of profit return and the factors that should be taken into account in the judge's discretion, at the same time, to perfect the relevant legislation, and to stipulate clearly, In order to effectively regulate the exercise of the judge's discretion, there are operable damage calculation standards, such as the use of fictitious licensing fee standards under certain circumstances.
