【摘要】：網頁是互聯(lián)網時代催生的新興事物,網頁既構成《著作權法》第3條項下的"其他作品",也構成第14條的匯編作品,這是《著作權法》立法宗旨和體系解釋下的合理推論。判斷構成作品的網頁及其源文件是否構成實質性相似時,可以分別根據(jù)"整體感知法"與"抽象—過濾—比較"法來認定;對于尚不構成作品的網頁,如果行為人的模仿行為滿足不正當競爭構成要件,權利人可以依據(jù)《反不正當競爭法》來維護自己的權利。
[Abstract]:Web page is a new thing in the Internet age. It not only constitutes the "other works" under Article 3 of the copyright Law, but also constitutes the compilation works of Article 14. This is a reasonable corollary under the interpretation of the legislative purpose and system of the copyright Law. When judging whether the web page that constitutes the work and its source files constitute substantial similarity. It can be determined according to "whole perception" method and "abstract-filter-comparison" method respectively; For a web page that does not constitute a work, if the act of imitation satisfies the constitutive elements of unfair competition, the right holder may defend his rights according to the Anti-unfair Competition Law.
