我國(guó)同人作品的著作權(quán)問(wèn)題研究

【摘要】:隨著網(wǎng)絡(luò)的普及,本來(lái)屬于小眾文化的同人作品的受眾越來(lái)越多,同時(shí),伴隨著同人作品的流行與興盛也產(chǎn)生了不少問(wèn)題,尤其是同人作品的著作權(quán)問(wèn)題。本文的第二部分將對(duì)我國(guó)同人作品的生存現(xiàn)狀進(jìn)行一個(gè)較為細(xì)致的描述,指出我國(guó)同人市場(chǎng)繁榮背后存在的種種問(wèn)題,同時(shí)指出因?yàn)樵谖覈?guó)現(xiàn)行的法律條文中缺乏對(duì)同人作品的明確定義和具體規(guī)范,使得同人作品的創(chuàng)作一直游走于合法與違法的邊緣,而當(dāng)其本身遭到侵權(quán)時(shí)也無(wú)法通過(guò)法律途徑保護(hù)自身權(quán)益。 我國(guó)同人作品的著作權(quán)問(wèn)題主要有兩個(gè)內(nèi)容:同人作品與被它使用的原作品之間的著作權(quán)糾紛問(wèn)題;以及同人作者是否擁有其同人作品著作權(quán)的問(wèn)題。針對(duì)這兩個(gè)問(wèn)題,在本文第三部分的論述中創(chuàng)新性地引入關(guān)于著作權(quán)與表達(dá)權(quán)之爭(zhēng)的平等主義思想,將同人作品認(rèn)定為創(chuàng)作者自由行使自己表達(dá)權(quán)的原創(chuàng)產(chǎn)物,其作者當(dāng)然的擁有它的著作權(quán),同時(shí)也因此同人作品與原作品在法律地位上是平等的,并非只有取得原作品著作權(quán)人許可才能進(jìn)行創(chuàng)作,從法理基礎(chǔ)上解決了前述的兩個(gè)問(wèn)題;并且在第三部分的論述中也會(huì)從我國(guó)促進(jìn)文化發(fā)展這個(gè)大背景出發(fā),指出同人作品大發(fā)展的背后是新時(shí)代的大眾參與文化的崛起,在這個(gè)新形勢(shì)下針對(duì)前兩個(gè)問(wèn)題做出當(dāng)前的最優(yōu)選擇。 當(dāng)我們從歷史的角度看待這個(gè)問(wèn)題時(shí),我們會(huì)發(fā)現(xiàn)著作權(quán)法律所有針對(duì)著作權(quán)的規(guī)制都是為了平衡這種獨(dú)占權(quán)利的益處和它可能對(duì)社會(huì)帶來(lái)的負(fù)面影響,所以當(dāng)現(xiàn)在這種平衡被打破,創(chuàng)造性被壓制,同人作品存在的違法嫌疑就很可能是法律的問(wèn)題而非它自身的問(wèn)題。在這種情形下改變法律應(yīng)當(dāng)是最優(yōu)選擇,至少在舊法變新法的過(guò)渡期問(wèn)中應(yīng)當(dāng)平衡對(duì)著作權(quán)的保護(hù)與鼓勵(lì)更多地創(chuàng)新,從而保障公眾的最大利益。因此本文的第四部分將會(huì)嘗試在我國(guó)現(xiàn)行法律的框架之內(nèi)通過(guò)借鑒國(guó)外的相關(guān)規(guī)定來(lái)解決我國(guó)同人作品的著作權(quán)問(wèn)題。 從鼓勵(lì)創(chuàng)作的立場(chǎng)出發(fā),將同人作品納入我國(guó)的法律框架之內(nèi),從而促進(jìn)新時(shí)代的社會(huì)文化的發(fā)展和進(jìn)步,這也是本文的研究意義所在。
[Abstract]:With the popularity of the network, the audience of the works belonging to the minority culture has become more and more. At the same time, with the popularity and prosperity of the works, there are also many problems. The second part of this paper will give a detailed description of the existing situation of Chinese co-human works, pointing out the problems behind the prosperity of the coowner market. At the same time, it is pointed out that because of the lack of clear definition and specific norms of the same person's works in the current legal provisions of our country, the creation of the same person's works has always been on the edge of legality and illegality. And when it itself is infringed, it can not protect its own rights and interests through legal channels. There are two main contents in the copyright of the co-owner 's works in China: the copyright dispute between the co-owner 's works and the original works used by it; And whether the co-author owns the copyright of his co-owner 's works. In view of these two problems, the third part of this paper discusses the innovative introduction of equal rights about copyright and the right of expression. The author of the same person works is regarded as the original product of the author's free exercise of his right of expression, and the author of the same person works has its copyright, and therefore the same person works and the original works are equal in the legal status. It is not only to obtain the license of the copyright owner of the original work to create works, but also to solve the two problems mentioned above on the basis of legal theory. And in the third part of the discussion will also from the background of promoting cultural development in China, pointing out that behind the great development of people's works is the rise of the new era of popular participation culture. In this new situation, the first two problems to make the current optimal choice. When we look at this issue from the historical point of view, we will find that all the copyright laws are aimed at balancing the benefits of this exclusive right and the negative impact it may bring to society. So when the balance is broken and creativity is suppressed, the suspicion of lawlessness in co-productions is likely to be a matter of law rather than its own. In this case, changing the law should be the best choice. At least in the transition period between the old law and the new law, the protection of copyright should be balanced and more innovation should be encouraged. Therefore, the 4th part of this paper will try to solve the copyright problem of co-owner 's works in our country by using the relevant regulations of foreign countries for reference within the framework of the current law of our country. In order to promote the development and progress of social culture in the new era, it is the significance of this study to bring the works of the same person into the legal framework of our country from the standpoint of encouraging creation.
