派遣制用工管理的關鍵問題與對策案例研究

【摘要】:隨著我國市場經濟的發(fā)展和用工制度改革的深度推進,勞動力市場主體地位的不斷強化,企業(yè)開始自主決定就業(yè)形式和用工模式。勞務派遣制以其降低企業(yè)人力成本、用工機制靈活、擴大就業(yè)等優(yōu)勢,得到了迅猛的發(fā)展。但“用工單位利用法律空白,規(guī)避勞動法的雇主責任,損害被派遣勞動者合法權益以及勞務派遣單位良莠不齊等現象”也一直存在。因而如何更為有效的保障勞務派遣者的合法權益,進一步規(guī)范勞務派遣市場的問題一直以來倍受各方的關注。 本文針對電信行業(yè)一家本地網企業(yè)—A公司的派遣制用工進行分析,通過第一手資料收集、問卷調查、訪談等方式深入了解、剖析目前派遣制用工管理中存在的關鍵問題和原因,同時結合派遣制員工的心理契約特征分析結果,最終對用工單位、勞務派遣機構和法律監(jiān)管機構提出可行性和合理化的派遣制用工改革建議。為我國勞務派遣行業(yè)朝著健康、良性的軌道快速發(fā)展提供可靠的依據和保障。
[Abstract]:With the development of China's market economy and the deepening of the reform of the employment system, the status of the main body of the labor market has been strengthened. Enterprises have begun to decide on employment forms and patterns independently. It has been a long time to use the legal blank to evade the employer's responsibility of labor law, to damage the legitimate rights and interests of the dispatched workers and the dispatched units'good and bad are uneven.
This paper analyzes the dispatch system of A company, a local network enterprise in the telecommunication industry, through the first-hand data collection, questionnaire survey, interviews and other ways to understand in-depth, analysis of the key problems and reasons in the management of dispatch system, and at the same time combined with the psychological contract characteristics of dispatch system staff analysis results, the final employment. Units, labor dispatch agencies and legal supervision institutions put forward feasible and reasonable suggestions on the reform of dispatch system, providing reliable basis and guarantee for the rapid development of labor dispatch industry in China towards a healthy and benign track.
