論工傷保險(xiǎn)賠償與民事侵權(quán)賠償之間的適用關(guān)系

【摘要】: 現(xiàn)代社會(huì)中,人們聚集在工廠、建筑工地等場(chǎng)所共同勞動(dòng),機(jī)器成為主要生產(chǎn)工具。隨著技術(shù)、經(jīng)濟(jì)的迅猛發(fā)展,工傷事故的發(fā)生日漸頻繁且后果日益嚴(yán)重,成為現(xiàn)代社會(huì)嚴(yán)重的社會(huì)問(wèn)題。工傷損害救濟(jì)機(jī)制已由原先的一元化逐漸向多元化發(fā)展,涉及侵權(quán)行為法和社會(huì)保險(xiǎn)法等多個(gè)領(lǐng)域,形成多種制度并存的局面。尤其是工傷保險(xiǎn)賠償與民事侵權(quán)賠償之間適用關(guān)系的處理問(wèn)題,因關(guān)系到勞動(dòng)者、用人單位、其他侵權(quán)人、社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)等多方利益,而似乎難以調(diào)和兼顧。目前各國(guó)解決工傷保險(xiǎn)賠償與民事侵權(quán)賠償之間適用關(guān)系問(wèn)題的方法主要有選擇、免除、兼得和補(bǔ)充四種模式。本文認(rèn)為,任何一種模式的適用都不存在法理上的障礙,只是每種模式適用的環(huán)境不同、看待分析每種模式的角度不同和選擇每種模式所追求的價(jià)值取向不同而已。 在我國(guó),相關(guān)的立法對(duì)工傷保險(xiǎn)賠償與民事侵權(quán)賠償?shù)倪m用關(guān)系雖有一些規(guī)定,但法條之間還是存在明顯的矛盾,給司法實(shí)踐帶來(lái)了諸多困難,出現(xiàn)“各依各的規(guī)定,各判各的案件”的現(xiàn)象。因此,在分析有關(guān)理論的基礎(chǔ)上,研究工傷保險(xiǎn)賠償與民事侵權(quán)賠償?shù)倪m用關(guān)系并提出完善我國(guó)適用方面的法律制度是本文的核心和歸宿。 本文將從分析工傷事故的性質(zhì)、研究工傷責(zé)任的演變著手,分析比對(duì)兩種賠償?shù)膮^(qū)別與聯(lián)系,具體闡述工傷保險(xiǎn)賠償與民事侵權(quán)賠償之間的適用關(guān)系,并結(jié)合我國(guó)的現(xiàn)實(shí)國(guó)情及未來(lái)發(fā)展,提出在我國(guó)無(wú)論是在(第三人侵權(quán)引致的)用人單位無(wú)因性工傷事故中還是在(用人單位負(fù)有故意或重大過(guò)失情形的)用人單位有因性工傷事故中,在工傷保險(xiǎn)賠償與侵權(quán)損害賠償適用的關(guān)系上,都可采用兼得模式。分析兼得模式的理論基礎(chǔ),其適用既不違背侵權(quán)法中的損益相抵原則,也不違背保險(xiǎn)法中的禁止得利原則;且兼得模式的適用既是對(duì)生命權(quán)和人權(quán)特別保護(hù)的體現(xiàn),也是適應(yīng)我國(guó)國(guó)情和索賠效率的需要。
[Abstract]:In modern society, people gather in factories, construction sites and other places to work together, machines become the main means of production. With the rapid development of technology and economy, the occurrence of industrial accidents is becoming more and more frequent and the consequences are becoming more and more serious, which has become a serious social problem in modern society. The mechanism of compensation for injury at work has gradually developed from the original monism to the diversification, involving the tort law and the social insurance law and other fields, forming a situation of coexistence of various systems. Especially the problem of dealing with the applicable relationship between industrial injury insurance compensation and civil tort compensation is difficult to reconcile with the interests of workers, employing units, other infringers, social insurance agencies and so on. At present, there are four ways to solve the problem of the applicable relationship between the compensation of industrial injury insurance and the compensation of civil tort in various countries, such as choice, exemption, acquirement and supplement. This paper holds that there are no legal obstacles to the application of any one of the models, except that each model is applied in a different environment, the angle of analysis of each model is different and the value orientation of choosing each model is different. In our country, although there are some provisions on the applicable relationship between industrial injury insurance compensation and civil tort compensation in relevant legislation, there are still obvious contradictions between the provisions of the law, which bring many difficulties to the judicial practice. The phenomenon of each case being adjudicated. Therefore, on the basis of the analysis of relevant theories, it is the core and end-result of this paper to study the applicable relationship between the compensation of industrial injury insurance and the compensation for civil tort and to put forward the perfection of the legal system of our country's application. This article will analyze the nature of industrial injury accident, study the evolution of industrial injury liability, analyze the difference and relation between the two kinds of compensation, and expound the applicable relationship between the compensation of industrial injury insurance and the compensation of civil tort. And combined with the reality of our country and its future development, It is proposed that in China, whether in the case of an employer's uncaused industrial injury (caused by the infringement of a third party) or in a situation where the employing unit has intentional or gross negligence, the employer has a work-related injury as a result of the accident. In the industrial injury insurance compensation and tort damages applicable to the relationship, both can adopt a concurrent mode. The application of this model is not contrary to the principle of profit or loss in tort law, nor to the principle of prohibition of gain and gain in insurance law, and the application of the model is the embodiment of the special protection of the right to life and human rights. It is also the need to adapt to the situation of our country and the efficiency of claims.
