【摘要】:在我國,企業(yè)規(guī)章制度合法性審查是企業(yè)規(guī)章制度合理、合法制定施行的重要基礎(chǔ)。由于規(guī)章制度是企業(yè)制定并與勞動者簽署的,就性質(zhì)來說,規(guī)章制度是一種勞動合同、集體合同、還是強制性的法律規(guī)定的定論模糊難定,這就造成了在勞動爭議解決過程中對規(guī)章制度合法性認定帶來很大的困擾。特別是對于勞動者而言,法律很少規(guī)定了企業(yè)制定規(guī)章制度所屬性質(zhì),這就為勞動者的權(quán)益保障帶來極大的困境。具體而言企業(yè)規(guī)章制度的合法性審查涉及到企業(yè)職工的具體利益,也是引領(lǐng)勞動關(guān)系成立的關(guān)鍵條件。如此說來,企業(yè)沒有合法的勞動紀律保證秩序,企業(yè)職工的行為將不受企業(yè)權(quán)利的約束,而企業(yè)的一些內(nèi)部行政行為都將失去法律上的根據(jù)。研究企業(yè)規(guī)章制度審查方面的法律問題,有利于完善企業(yè)規(guī)章制度體系,有利于確保企業(yè)實現(xiàn)合法規(guī)范化運作,保障企業(yè)按照國家法律規(guī)定合法運營,有利與預(yù)防和節(jié)制可能發(fā)生的勞動爭議,維護社會的和諧與穩(wěn)定。勞動者認定并同意與企業(yè)規(guī)章后,勞動者就應(yīng)依規(guī)章制度全面遵守其義務(wù),但一旦規(guī)章制度違法所產(chǎn)生的責任糾紛也是最容易產(chǎn)生糾紛的情形,一部分涉及企業(yè)的責任承擔原則,另外一部分是有涉及企業(yè)職工的基本利益保障。所以在司法實踐中法官對規(guī)章制度違法責任分配的認識尤為重視,立法上也有諸多問題需要完善和解決。但自勞動法出臺以來,我國企業(yè)規(guī)章制度日益完善并得到長足發(fā)展,由于勞動者和企業(yè)法律意識仍然較為淡薄以及我國相關(guān)立法和司法上的多種因素,我國法律還未明確相關(guān)企業(yè)規(guī)章制度的法律、法規(guī),這就造成了在企業(yè)制定的規(guī)章制度的法律效力適用上,規(guī)章制度違法的責任分配等問題上,特別是在規(guī)章制度合法性審查上我國立法的不足。為維護廣大勞動者的合法權(quán)益不受侵犯,規(guī)范企業(yè)規(guī)章制度的制定,使企業(yè)的規(guī)章制度發(fā)揮其積極作用,上述問題都是需要法律亟待解決和完善的。本文旨在通過對企業(yè)規(guī)章制度這一構(gòu)建性極強的法律制度進行比較全面的分析和探討,就一些在理論界和司法實踐中爭議較多的問題提出自己的看法,并對完善我國企業(yè)規(guī)章制度合法性審查的構(gòu)建提出一些建議。第一部分是緒論,簡要闡述了問題的提出和研究背景,對一些相關(guān)概念進行界定,簡述國內(nèi)研究,并就現(xiàn)有研究指出不足。第二部分是案例介紹,詳細闡述三則案例案由和結(jié)果,總結(jié)案例爭議焦點,為以下案例分析做準備。第三部分是案例法理分析,主要論述規(guī)章制度合法性審查的概念、適用和責任分配,著力于法理結(jié)合案例分析規(guī)章制度合法性審查問題。第四部分是研究結(jié)論與啟示,論述了規(guī)章制度合法性審查的研究結(jié)論,并對結(jié)論給于的幾點啟示提出一些建議。最后部分是結(jié)語,指出了一些研究的不足與展望。
[Abstract]:In our country, the legality examination of enterprise rules and regulations is an important foundation for the establishment and implementation of enterprise rules and regulations.Since the rules and regulations are formulated by the enterprise and signed with the workers, it is difficult to determine whether the rules and regulations are by nature a kind of labor contract, a collective contract, or a conclusion of compulsory legal provisions.This results in the labor dispute settlement process to the rules and regulations legitimacy determination brings a lot of trouble.Especially for workers, the laws rarely stipulate the nature of the rules and regulations, which brings great difficulties for the protection of workers' rights and interests.Specifically, the legality examination of enterprise rules and regulations involves the specific interests of employees, and is also the key condition to lead the establishment of labor relations.So, the enterprise does not have the legal labor discipline to guarantee the order, the enterprise worker's behavior will not be bound by the enterprise right, and the enterprise's some internal administrative behavior all will lose the legal basis.The study of the legal problems in the examination of the enterprise's rules and regulations is conducive to perfecting the enterprise's system of rules and regulations, to ensuring that the enterprise realizes the lawful and standardized operation, and to ensuring the enterprise's legal operation in accordance with the provisions of the state lawTo prevent and control possible labor disputes and maintain social harmony and stability.Once the laborer has recognized and agreed to the rules and regulations of the enterprise, the laborer shall fully abide by his obligations in accordance with the rules and regulations, but once the liability dispute arising from the violation of the rules and regulations is also the most susceptible to dispute,Part involves the principle of corporate responsibility, the other part involves the basic interests of employees.Therefore, in the judicial practice, judges pay particular attention to the distribution of illegal liability of rules and regulations, and there are many problems in legislation that need to be improved and solved.However, since the introduction of labor law, the rules and regulations of enterprises in our country have been perfected and developed rapidly, because the legal consciousness of workers and enterprises is still relatively weak, as well as many factors related to legislation and judicature in our country.The laws and regulations of our country have not been clear about the rules and regulations of the enterprises. This has resulted in the application of the rules and regulations formulated by the enterprises, the distribution of responsibilities for the violation of the rules and regulations, and so on.Especially in the regulatory legality review of the lack of legislation in our country.In order to protect the legitimate rights and interests of workers, standardize the establishment of enterprise rules and regulations, and make the rules and regulations of enterprises play a positive role, the above problems need to be solved and perfected.The purpose of this paper is to make a more comprehensive analysis and discussion on the enterprise rules and regulations, which is a highly constructive legal system, and to put forward some views on some controversial issues in the theoretical circle and judicial practice.And put forward some suggestions to perfect the legality examination of enterprise rules and regulations in our country.The first part is the introduction, briefly describes the question and the research background, defines some related concepts, briefly describes the domestic research, and points out the shortcomings of the existing research.The second part is the case introduction, elaborates the three case cases and the results, summarizes the focus of the case dispute, and prepares the following case analysis.The third part is case jurisprudence analysis, which mainly discusses the concept, application and responsibility distribution of rules and regulations legality examination.The fourth part is the conclusion and enlightenment of the research, discusses the conclusion of the legality examination of rules and regulations, and puts forward some suggestions to the enlightenment of the conclusion.The last part is the conclusion, pointing out some deficiencies and prospects of the research.
