公共管理視角下的企業(yè)社會(huì)責(zé)任研究

【摘要】:何謂企業(yè)社會(huì)責(zé)任?簡(jiǎn)而言之,就是企業(yè)在創(chuàng)造利潤(rùn)、對(duì)股東承擔(dān)法律責(zé)任的同時(shí),還主動(dòng)承擔(dān)起對(duì)員工、消費(fèi)者、公益事業(yè)和環(huán)境等方面的責(zé)任,包括遵守商業(yè)道德、生產(chǎn)安全、職業(yè)健康、保護(hù)勞動(dòng)者的合法權(quán)益、保護(hù)環(huán)境、支持慈善事業(yè)、捐助社會(huì)公益、保護(hù)弱勢(shì)群體等等。 然而,中國(guó)的大多數(shù)企業(yè)普遍處于盲目追求短期經(jīng)濟(jì)利益的階段,未能看清社會(huì)的長(zhǎng)遠(yuǎn)發(fā)展趨勢(shì),企業(yè)短視行為嚴(yán)重。一方面,認(rèn)為企業(yè)社會(huì)責(zé)任的履行是企業(yè)單方面經(jīng)濟(jì)利益的流出;另一方面,未能意識(shí)到企業(yè)社會(huì)責(zé)任的履行給企業(yè)所帶來(lái)的社會(huì)效益,造成了大部分企業(yè)只注重股東利益,對(duì)員工、消費(fèi)者、利益相關(guān)者、公益事業(yè)和環(huán)境存在社會(huì)責(zé)任缺失的現(xiàn)狀。企業(yè)社會(huì)責(zé)任缺失的原因主要是中國(guó)企業(yè)內(nèi)部的社會(huì)責(zé)任建設(shè)意識(shí)淡薄、執(zhí)行不力,以及外部激勵(lì)不足、監(jiān)管不嚴(yán),這里所講的“外部”主要指社會(huì)和政府,其中政府的監(jiān)管不力成為企業(yè)社會(huì)責(zé)任缺失最主要的原因。 雖然我國(guó)有許多法律法規(guī)涉及到企業(yè)社會(huì)責(zé)任,但由于我國(guó)執(zhí)法力度不夠,而不能有效的實(shí)現(xiàn)制約企業(yè)忽視企業(yè)社會(huì)責(zé)任的違規(guī)行為發(fā)生。我國(guó)的《勞動(dòng)法》充分規(guī)定了企業(yè)如何對(duì)待員工的條例,著重強(qiáng)調(diào)了針對(duì)員工最低工資的標(biāo)準(zhǔn),企業(yè)提供員工的工作環(huán)境的標(biāo)準(zhǔn)等等。然而由于我國(guó)沒(méi)有相應(yīng)的執(zhí)行法律法規(guī),違反《勞動(dòng)法》的行為,沒(méi)有得到應(yīng)有的懲戒,《勞動(dòng)法》的約束效果并不明顯。其他相關(guān)部門(mén),如財(cái)政、紀(jì)檢監(jiān)察沒(méi)有相互有效傳遞信息,組成對(duì)企業(yè)社會(huì)責(zé)任的網(wǎng)狀管理?偟膩(lái)說(shuō),行政主體沒(méi)有最大限度地產(chǎn)生對(duì)企業(yè)社會(huì)責(zé)任的干預(yù),沒(méi)有形成迫使企業(yè)履行社會(huì)責(zé)任的壓力。 如果要解決我國(guó)企業(yè)社會(huì)責(zé)任缺失的現(xiàn)狀,單靠企業(yè)的自覺(jué)性是不現(xiàn)實(shí)的,政府在讓企業(yè)履行社會(huì)責(zé)任問(wèn)題上起著最為重要的作用,規(guī)范制約企業(yè)行為,使企業(yè)在注重經(jīng)濟(jì)效益的同時(shí),兼顧生態(tài)效益與社會(huì)效益,成為政府的重要責(zé)任。為此,政府要有一套良好的制度設(shè)計(jì),強(qiáng)化對(duì)企業(yè)的監(jiān)督與制約。
[Abstract]:What is corporate social responsibility? In short, while making profits and assuming legal responsibility to shareholders, enterprises also take the initiative to take responsibility for employees, consumers, public welfare undertakings and the environment, including compliance with business ethics, production safety, and occupational health. Protect the legitimate rights and interests of workers, protect the environment, support philanthropy, contribute to social welfare, protect vulnerable groups, and so on. However, the majority of Chinese enterprises are generally in the stage of blindly pursuing short-term economic benefits and fail to see the long-term development trend of society. The short-sighted behavior of enterprises is serious. On the one hand, It is considered that the fulfillment of corporate social responsibility is the outflow of unilateral economic benefits of enterprises; on the other hand, the failure to realize the social benefits brought by the performance of corporate social responsibility results in the majority of enterprises paying attention only to the interests of shareholders and to their employees. Consumers, stakeholders, public welfare undertakings and the environment are in the absence of social responsibility. The main reasons for the lack of corporate social responsibility are the weak awareness of social responsibility construction within Chinese enterprises, poor implementation, and inadequate external incentives. Supervision is not strict, the "external" mainly refers to the society and the government, and the lack of government supervision is the main reason for the lack of corporate social responsibility. Although there are many laws and regulations related to corporate social responsibility in our country, however, the law enforcement in our country is not strong enough. China's Labor Law fully stipulates the regulations on how enterprises treat their employees, with emphasis on the standard of minimum wage for employees. However, because our country does not have the corresponding enforcement laws and regulations, violates the "labor law" the behavior, did not receive the due punishment, "the labor law" the restraint effect is not obvious. Other related departments, For example, finance, discipline inspection and supervision do not effectively transmit information to each other and form a network of management of corporate social responsibility. In general, the administrative body does not have the greatest interference in corporate social responsibility. There is no pressure to force companies to fulfill their social responsibilities. If we want to solve the current situation of the lack of corporate social responsibility in our country, it is unrealistic to rely solely on enterprise consciousness. The government plays the most important role in enabling enterprises to fulfill their social responsibility and normalizes and restricts enterprise behavior. Therefore, the government should have a set of good system design, strengthen the supervision and restriction to the enterprise.
