【摘要】:隨著市場經(jīng)濟的發(fā)展,職業(yè)體育應(yīng)運而生,市場規(guī)律在體育領(lǐng)域內(nèi)的應(yīng)用,,也導(dǎo)致了職業(yè)運動員和職業(yè)體育俱樂部的出現(xiàn)。作為職業(yè)體育中不可或缺部分的職業(yè)運動員,他們往往占有的社會資源較少,因此在與職業(yè)俱樂部的對抗當(dāng)中,職業(yè)運動員處于一種弱勢地位。職業(yè)體育集體談判制度不僅對職業(yè)運動員有十分重要的意義,同時對于職業(yè)體育的和諧發(fā)展也意義重大。由于我國的職業(yè)體育起步較晚,與西方職業(yè)體育相比在制度上存在著很多的不足。俱樂部侵犯職業(yè)運動員合法權(quán)益的現(xiàn)象時有發(fā)生。我國目前雖然在《勞動合同法》里明確規(guī)定勞動者擁有集體談判的權(quán)利,但是在職業(yè)體育的領(lǐng)域內(nèi),職業(yè)運動員工會尚未成立,職業(yè)體育聯(lián)盟也沒有形成,因此職業(yè)體育集體談判制度對于我國職業(yè)體育運動員來說,猶如水中月,鏡中花,近在眼前卻無法觸及。本文通過運用文獻研究法、系統(tǒng)分析法、比較分析法等研究方法對職業(yè)體育集體談判制度、構(gòu)建職業(yè)體育集體談判制度的必備要素以及我國職業(yè)體育領(lǐng)域內(nèi)的集體談判現(xiàn)狀進行了相關(guān)的研究。 首先,本文對職業(yè)運動員進行了定義,確定了研究主體的范圍。職業(yè)運動員作為一種特殊的勞動者,其與俱樂部的關(guān)系應(yīng)當(dāng)屬于一種特殊的勞動關(guān)系。因此,職業(yè)運動員也應(yīng)該享有法律賦予的集體談判權(quán)利。 其次,本文對職業(yè)體育集體談判制度的進行了系統(tǒng)性的介紹,對職業(yè)體育集體談判制度的程序,集體談判合同的內(nèi)容進行了歸納和總結(jié)。西方職業(yè)體育的集體談判制度已較為成熟,因此對于我國的職業(yè)體育集體談判制度有十分寶貴的借鑒經(jīng)驗。 再次,對我國目前職業(yè)體育發(fā)展現(xiàn)狀及構(gòu)建集體談判制度時存在的問題進行了分析。由于我國職業(yè)體育管理模式的不健全,直接導(dǎo)致了目前我國職業(yè)運動員集體談判制度無法有效施行,對職業(yè)體育的健康發(fā)展也造成了極大的危害。 最后,在上文論述的基礎(chǔ)之上,針對我國目前的職業(yè)體育現(xiàn)狀,提出了對我國職業(yè)體育集體談判制度的完善建議和構(gòu)想。
[Abstract]:With the development of market economy, professional sports emerge as the times require, and the application of market law in the field of sports also leads to the emergence of professional athletes and professional sports clubs. They tend to occupy less social resources, so in the confrontation with professional clubs, professional athletes are in a weak position. Professional sports collective bargaining system is not only very important for professional athletes, At the same time, it is of great significance to the harmonious development of professional sports. Compared with the western professional sports, there are many deficiencies in the system. The phenomenon of club infringing on the legitimate rights and interests of professional athletes occurs from time to time. Although the labor contract law in our country clearly stipulates that workers have the right to collective bargaining, But in the field of professional sports, the trade union of professional athletes has not yet been established and the professional sports federation has not been formed, so the collective bargaining system of professional sports is like a month in the water and flowers in the mirror for professional sports athletes in our country. Through the methods of literature research, systematic analysis, comparative analysis and other research methods, this paper discusses the system of collective bargaining in professional sports. The essential elements of constructing the collective bargaining system of professional sports and the present situation of collective bargaining in the field of professional sports in China are studied. First of all, this paper defines professional athletes and determines the scope of research subjects. As a special kind of laborers, the relationship between professional athletes and clubs should belong to a special kind of labor relationship. Professional athletes should also enjoy collective bargaining rights conferred by law. Secondly, this paper systematically introduces the system of collective bargaining of professional sports, and the procedure of collective bargaining system of professional sports. The content of collective bargaining contract has been summarized and summarized. The collective bargaining system of western professional sports has been more mature, so it has very valuable experience for our professional sports collective bargaining system. Thirdly, the author analyzes the current situation of professional sports development and the problems in the construction of collective bargaining system. As a direct result, the collective bargaining system of professional athletes in our country can not be implemented effectively, and it also causes great harm to the healthy development of professional sports. Finally, on the basis of the discussion above, according to the present situation of professional sports in our country, the author puts forward some suggestions and ideas to perfect the collective bargaining system of professional sports in our country.
