【摘要】：多式聯(lián)運(yùn)法規(guī)制度是多式聯(lián)運(yùn)發(fā)展的基礎(chǔ)和保障,本文首先通過文獻(xiàn)分析、全國(guó)重點(diǎn)多式聯(lián)運(yùn)企業(yè)的調(diào)研問卷分析及多個(gè)省份多式聯(lián)運(yùn)立法情況的調(diào)研走訪,總結(jié)了我國(guó)多式聯(lián)運(yùn)立法的現(xiàn)狀,剖析闡述了我國(guó)多式聯(lián)運(yùn)立法存在的多式聯(lián)運(yùn)專用法案缺乏、行政法規(guī)缺失、責(zé)任劃分不明晰等問題,立足多式聯(lián)運(yùn)發(fā)展對(duì)規(guī)范多式聯(lián)運(yùn)當(dāng)事人經(jīng)營(yíng)行為和穩(wěn)定有序的發(fā)展環(huán)境的訴求角度,提出了多式聯(lián)運(yùn)發(fā)展對(duì)法規(guī)政策的需求包括行政法規(guī)和民商法規(guī)兩方面的需求,最后,針對(duì)我國(guó)多式聯(lián)運(yùn)立法存在的問題和多式聯(lián)運(yùn)發(fā)展對(duì)法規(guī)政策的需求,提出了加快我國(guó)多式聯(lián)運(yùn)法規(guī)制度建設(shè)的對(duì)策建議。
[Abstract]:The legal system of multimodal transport is the foundation and guarantee for the development of multimodal transport. Firstly, through the literature analysis, the questionnaire analysis of the national key multimodal transport enterprises and the investigation and visit of multimodal transport legislation in many provinces, This paper summarizes the present situation of multimodal transport legislation in China, analyzes and expounds the lack of special legislation on multimodal transport, the lack of administrative laws and regulations, and the unclear division of responsibilities, which exist in the legislation of multimodal transport in China. Based on the demand of multimodal transport development for regulating the management behavior of multimodal transport parties and the stable and orderly development environment, this paper puts forward the requirements of multimodal transport development for regulations and policies, including administrative regulations and civil and commercial laws and regulations. Finally, the paper puts forward the requirements of multimodal transport development from two aspects: administrative regulations and civil and commercial laws and regulations. In view of the problems existing in the legislation of multimodal transport in our country and the requirement of the development of multimodal transport to the regulations and policies, this paper puts forward some countermeasures and suggestions to speed up the construction of the legal system of multimodal transport in China.
