【摘要】：當(dāng)今中國社會中,私設(shè)“小金庫”問題已成為一大毒瘤。從1989年開始,我國前后一共進(jìn)行過11次全國范圍內(nèi)的“小金庫”專項(xiàng)治理工作,雖然每次治理都取得了明顯成效,但不久之后,階段性成果便很快被新的現(xiàn)狀所淹沒,個(gè)別單位及地區(qū)甚至出現(xiàn)越治越大的態(tài)勢,嚴(yán)重制約了社會經(jīng)濟(jì)發(fā)展、擾亂了社會經(jīng)濟(jì)秩序。是以,為了完善社會主義市場經(jīng)濟(jì)秩序、完成資源合理配置、構(gòu)建和諧社會,必須根除“小金庫”。目前,針對防治“小金庫”問題的研究主要是通過經(jīng)濟(jì)、審計(jì)的角度出發(fā),或者只是籠統(tǒng)提到需要完善相關(guān)法律,極少有通過法律途徑防治的具體建議。本文通過對“小金庫”問題的歷史沿革、概念界定、社會危害性、治理情況、法律現(xiàn)狀等研究發(fā)現(xiàn)法律規(guī)制不完善、懲處力度不足、責(zé)任追究落實(shí)不到位、缺乏監(jiān)督機(jī)制是造成“小金庫”無法根治的重要原因,因此,本文針對以上問題進(jìn)一步提出將“小金庫”納入我國法律法規(guī)體系、加大懲處力度、落實(shí)責(zé)任追究、建立健全監(jiān)督機(jī)制等有效的法律完善建議。
[Abstract]:In today's Chinese society, the problem of setting up "small coffers" has become a major tumor. Since 1989, our country has carried out a total of 11 "small coffers" special management work around the country before and after, although every time has achieved obvious results, but soon after, the phased results will soon be submerged by the new status quo. Individual units and regions even appear the situation of increasing governance, seriously restricting the development of social and economic, disrupting the social and economic order. Therefore, in order to perfect the socialist market economy order, complete the rational allocation of resources and build a harmonious society, we must eradicate the "small treasury". At present, the research on the prevention and cure of "small treasury" is mainly from the angle of economy and audit, or simply refers to the need to perfect the relevant laws, and very few concrete suggestions on prevention and cure through legal channels are made. Through the historical evolution, concept definition, social harmfulness, governance and legal status of the "small vault", this paper finds that the legal regulation is not perfect, the punishment is insufficient, the responsibility investigation is not in place, and so on. The lack of supervision mechanism is an important reason why the "small treasury" cannot be cured. Therefore, in view of the above problems, this paper further proposes that the "small vault" be incorporated into the law and regulation system of our country, increase the intensity of punishment, and carry out the accountability investigation. Establish and improve the supervision mechanism and other effective legal recommendations.
