【摘要】：金磚國(guó)家基本上都建立了以銀行為中心,其他金融機(jī)構(gòu)類別多元發(fā)展的金融機(jī)構(gòu)體系。近年來,金磚國(guó)家銀行業(yè)整體實(shí)力明顯上升,服務(wù)能力逐步增強(qiáng),資產(chǎn)質(zhì)量顯著提高,國(guó)際影響力也在逐漸提升。在金融全球化的影響下,銀行業(yè)市場(chǎng)準(zhǔn)入法律制度的建立,對(duì)于促進(jìn)本國(guó)銀行業(yè)的發(fā)展以及防范金融風(fēng)險(xiǎn)起著舉足輕重的作用。關(guān)于銀行業(yè)外資準(zhǔn)入方面的研究逐漸增多,但是目前還沒有學(xué)者對(duì)金磚國(guó)家銀行業(yè)外資準(zhǔn)入的實(shí)體條件進(jìn)行對(duì)比研究。本文將運(yùn)用比較分析的方法對(duì)金磚國(guó)家銀行業(yè)外資準(zhǔn)入的實(shí)體條件進(jìn)行比較研究,填補(bǔ)了金磚國(guó)家銀行業(yè)外資準(zhǔn)入實(shí)體條件法律問題研究的空白。本文將通過對(duì)金磚各國(guó)在WTO金融服務(wù)法律規(guī)則、各國(guó)加入的區(qū)域貿(mào)易體制與各國(guó)國(guó)內(nèi)有關(guān)銀行業(yè)市場(chǎng)準(zhǔn)入法律制度的比較分析,剖析金磚各國(guó)在銀行業(yè)市場(chǎng)準(zhǔn)入法律制度方面所存在的問題,分別就協(xié)調(diào)國(guó)際法和國(guó)內(nèi)法提出了的方案,為促進(jìn)金磚各國(guó)銀行業(yè)服務(wù)貿(mào)易進(jìn)一步發(fā)展奠定基礎(chǔ)。本文除引言和結(jié)語(yǔ)外,由四個(gè)部分構(gòu)成:第一部分“金磚各國(guó)對(duì)銀行業(yè)外資準(zhǔn)入法律規(guī)制”,主要闡述中國(guó)、印度、俄羅斯、巴西、南非五國(guó)有關(guān)銀行業(yè)外資準(zhǔn)入實(shí)體條件方面法律的規(guī)則,指出了金磚國(guó)家對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件法律調(diào)控的差異,提出了對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件規(guī)定較為薄弱的國(guó)家應(yīng)當(dāng)借鑒對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件規(guī)定較為全面的國(guó)家。第二部分“金磚國(guó)家對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件的國(guó)際法比較”,主要從WTO體制下的承諾和區(qū)域貿(mào)易體制下的承諾兩個(gè)方面分析金磚國(guó)家對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件的區(qū)別與問題,并提出金磚國(guó)家間銀行業(yè)外資準(zhǔn)入實(shí)體條件的國(guó)際法協(xié)調(diào)的方法,協(xié)調(diào)的意見主要是簽署一部金磚國(guó)家銀行業(yè)服務(wù)貿(mào)易協(xié)定,在金磚國(guó)家內(nèi)建立統(tǒng)一的市場(chǎng)準(zhǔn)入制度。第三部分“金磚國(guó)家銀行業(yè)外資準(zhǔn)入實(shí)體條件的國(guó)內(nèi)法比較”,分別從注冊(cè)資金、主體資格、外資比例、經(jīng)營(yíng)范圍四個(gè)方面對(duì)金磚國(guó)家對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件的國(guó)內(nèi)法的規(guī)定進(jìn)行比較,指出金磚國(guó)家國(guó)內(nèi)法在銀行業(yè)外資準(zhǔn)入實(shí)體條件方面存在的問題。問題主要表現(xiàn)在國(guó)家安全標(biāo)準(zhǔn)存在差異,個(gè)別國(guó)家對(duì)銀行業(yè)外資準(zhǔn)入實(shí)體條件的規(guī)定不全面,多數(shù)國(guó)家在主體資格、注冊(cè)資金、外資比例和業(yè)務(wù)范圍上的限制過于嚴(yán)格。本文提出金磚國(guó)家間銀行業(yè)外資準(zhǔn)入實(shí)體條件的國(guó)內(nèi)法協(xié)調(diào)的方法,協(xié)調(diào)的方法包括明確國(guó)家安全標(biāo)準(zhǔn),借鑒其他國(guó)家相關(guān)的規(guī)定,完善立法。第四部分“金磚國(guó)家銀行業(yè)外資準(zhǔn)入實(shí)體條件法律協(xié)調(diào)的建議方案”,主要根據(jù)金磚國(guó)家各國(guó)的優(yōu)劣勢(shì),提出金磚國(guó)家間銀行業(yè)外資準(zhǔn)入實(shí)體條件法律協(xié)調(diào)的建議方案。建議方案從主體資格、注冊(cè)資金、外資比例和業(yè)務(wù)范圍這四個(gè)方面。
[Abstract]:BRICS countries have basically established a banking-centric financial institution system with diversified types of other financial institutions. In recent years, the BRICS banking sector as a whole has grown significantly in strength, service capacity, asset quality and international influence. Under the influence of financial globalization, the establishment of legal system of banking market access plays an important role in promoting the development of domestic banking and preventing financial risks. There are more and more researches on the foreign investment access of the banking industry, but no scholars have made a comparative study on the substantive conditions of the foreign investment access in the BRICS banking sector. This paper uses the method of comparative analysis to make a comparative study on the substantive conditions of the foreign investment access of the BRICS banks, which fills the gap in the legal research on the substantive conditions of the foreign investment access of the BRICS banks. This paper will compare the rules of BRICS countries' financial services in WTO, the regional trading system of BRICS countries and the domestic market access legal system of BRICS countries. This paper analyzes the problems existing in the legal system of banking market access in BRICS countries, and puts forward some proposals on harmonizing international and domestic laws, which will lay a foundation for the further development of BRICS banking trade in services. In addition to the introduction and conclusion, this paper is composed of four parts: the first part, "the BRICS countries' legal regulation of foreign investment access to the banking sector", mainly expounds China, India, Russia, Brazil, The rules of the five South African countries on the legal conditions for the entry of foreign investment in the banking sector point out the differences between the BRICS countries in the legal regulation and control of the conditions for the entry of foreign investment in the banking sector. It is pointed out that countries with weak requirements for foreign capital entry should draw lessons from countries with more comprehensive requirements for foreign capital entry. Part two, "comparison of BRICS countries' International Law on the conditions of Foreign Investment admission entities", This paper mainly analyzes the differences and problems between the BRICS countries' conditions of entry to foreign investment in the banking sector from the two aspects of the commitments under the WTO system and the commitments under the regional trading system. This paper also puts forward a method of international law coordination of the conditions of foreign investment access for BRICS banks. The coordinated opinion is mainly to sign a BRICS agreement on banking services trade and to establish a unified market access system within BRICS countries. The third part, "comparison of domestic laws on the conditions of entry of foreign investment in BRICS banking sector", respectively, from the aspects of registered funds, subject qualifications, and the proportion of foreign capital. This paper compares the provisions of BRICS countries' domestic laws on the conditions of foreign capital entry in the banking industry in four aspects, and points out the problems existing in the domestic laws of the BRICS countries in terms of the conditions of entry of foreign investment in the banking sector. The main problems are that there are differences in national security standards, individual countries do not have comprehensive regulations on the substantive conditions of entry for foreign investment in the banking industry, and most countries have too strict restrictions on subject qualification, registered funds, proportion of foreign capital and scope of business. This paper puts forward a method to harmonize the domestic laws of the BRICS banks' foreign capital entry entity conditions. The methods of coordination include clarifying the national security standards, drawing lessons from the relevant provisions of other countries, and perfecting the legislation. The fourth part of the "the BRICS banking foreign investment entry entity conditions of the legal coordination proposal", mainly according to the advantages and disadvantages of the BRICS countries, put forward the BRICS countries among the banking foreign investment entry entity conditions of the legal coordination of the proposed proposal. Suggestions from the main qualifications, registered funds, foreign capital ratio and business scope of these four aspects.
