【摘要】：國內(nèi)保理業(yè)務(wù)在我國經(jīng)濟快速增長的宏觀環(huán)境下,近年來得到了快速的發(fā)展。但國內(nèi)保理業(yè)務(wù)目前為止仍以銀行作保理商的占絕大部分業(yè)務(wù)量。本文所研究的主要對象是以國內(nèi)非銀行機構(gòu)作為國內(nèi)保理商的國內(nèi)保理業(yè)務(wù),即稱國內(nèi)商業(yè)保理。通過對國內(nèi)商業(yè)保理的法律性質(zhì)、法律基礎(chǔ)、法律環(huán)境以及當(dāng)事人權(quán)利義務(wù)關(guān)系的分析,重點揭示了該項業(yè)務(wù)的法律風(fēng)險和操作風(fēng)險等風(fēng)險狀況,并為此嘗試性地提出了不斷完善我國相關(guān)法律法規(guī)和建立監(jiān)管體系、加強行業(yè)監(jiān)督等一系列思路,推進國內(nèi)商業(yè)保理業(yè)務(wù)健康、穩(wěn)健發(fā)展。
[Abstract]:The domestic factoring business has developed rapidly in recent years under the macro environment of rapid economic growth in China. But the domestic factoring business so far still take the bank as the factor account for most of the business. The main research object of this paper is domestic factoring business, which is called domestic commercial factoring. Based on the analysis of the legal nature, legal basis, legal environment and the relationship between the rights and obligations of the parties, the legal risk and operational risk of the business are revealed. In order to promote the healthy and steady development of domestic commercial factoring business, this paper tries to improve the relevant laws and regulations of our country, establish the supervision system, strengthen the supervision of the industry, and so on.
