【摘要】：現(xiàn)場(chǎng)簽證是工程發(fā)承包雙方在建設(shè)過程中補(bǔ)償合同狀態(tài)失衡的重要手段,具有快速性與靈活性,但是常因?yàn)槠湫Я栴}引起雙方的爭(zhēng)議。根據(jù)最高人民法院司法解釋,結(jié)合2013清單規(guī)范以及工程價(jià)款結(jié)算暫行辦法等相關(guān)文件的規(guī)定,配合實(shí)際判例,厘清實(shí)現(xiàn)現(xiàn)場(chǎng)簽證的法律效力,為雙方解決此類糾紛提供共同的依據(jù)。
[Abstract]:On-site visa is an important means for both parties to compensate for the imbalance of contract state in the process of construction. It is quick and flexible, but it is often disputed by both parties because of its effectiveness. In accordance with the judicial interpretation of the Supreme people's Court and the provisions of the relevant documents such as the specification of the 2013 list and the interim measures for the settlement of project prices, and in accordance with practical cases, the legal effect of realizing on-site visas is clarified. To provide a common basis for both parties to resolve such disputes.
