移動通信轉(zhuǎn)售業(yè)務(wù)的反壟斷法分析

【摘要】:文章在簡要介紹我國移動通信轉(zhuǎn)售業(yè)務(wù)的基礎(chǔ)上,對移動通信轉(zhuǎn)售過程中接入和零售這兩個基本環(huán)節(jié)中轉(zhuǎn)售企業(yè)與基礎(chǔ)運(yùn)營商之間的關(guān)系進(jìn)行了分析,隨后,文章結(jié)合電信產(chǎn)業(yè)的網(wǎng)絡(luò)型特征著重對移動通信網(wǎng)絡(luò)接入環(huán)節(jié)中市場主體的地位特別是基礎(chǔ)運(yùn)營商的市場支配地位進(jìn)行了分析,并在此基礎(chǔ)上對接入市場可能出現(xiàn)的濫用市場支配地位以及壟斷協(xié)議行為進(jìn)行了預(yù)判和梳理。文章由六個部分組成:導(dǎo)論呈現(xiàn)文章的選題背景并介紹了學(xué)界對移動通信領(lǐng)域引入競爭的相關(guān)研究成果。簡單交待了創(chuàng)新點(diǎn)及諸多不足之處。此外,本部分還廓清了研究范圍,指出本文主要研究移動通信轉(zhuǎn)售業(yè)務(wù)可能引發(fā)的經(jīng)濟(jì)性壟斷且不包括其中的經(jīng)營者集中行為。第一章在簡要介紹移動通信轉(zhuǎn)售業(yè)務(wù)的基礎(chǔ)上,從反壟斷法的角度對轉(zhuǎn)售業(yè)務(wù)的競爭效果、相關(guān)市場、經(jīng)營者之間的關(guān)系等進(jìn)行了分析。指出轉(zhuǎn)售業(yè)務(wù)既有促進(jìn)競爭的積極效果,同時(shí),圍繞轉(zhuǎn)售業(yè)務(wù),也可能發(fā)生一些限制競爭的行為,運(yùn)營商開展競爭的相關(guān)市場為移動通信服務(wù)市場,運(yùn)營商之間存在既合作又競爭的關(guān)系,在批發(fā)環(huán)節(jié),基礎(chǔ)運(yùn)營商與轉(zhuǎn)售企業(yè)之間是合作關(guān)系,而在零售環(huán)節(jié),所有運(yùn)營商之間互為競爭者。在以上分析的基礎(chǔ)上,本章提出了轉(zhuǎn)售業(yè)務(wù)可能引發(fā)的反壟斷法擔(dān)憂。第二章著重分析轉(zhuǎn)售業(yè)務(wù)相關(guān)的濫用市場支配地位,主要結(jié)合網(wǎng)絡(luò)性的產(chǎn)業(yè)特征對濫用市場支配地位的行為類型、表現(xiàn)形式展開分析,指出基礎(chǔ)運(yùn)營商可能濫用其優(yōu)勢拒絕轉(zhuǎn)售企業(yè)接入、收取不公平的高價(jià)或?yàn)樵诹闶鄹偁幹姓嫉孟葯C(jī)而惡意降低接入質(zhì)量。第三章主要分析了圍繞轉(zhuǎn)售業(yè)務(wù)可能發(fā)生的壟斷協(xié)議,特別是接入環(huán)節(jié)的縱向壟斷協(xié)議和橫向壟斷協(xié)議,指出基礎(chǔ)運(yùn)營商之間可能就接入價(jià)格等接入條件進(jìn)行共謀,而各基礎(chǔ)運(yùn)營商在與轉(zhuǎn)售企業(yè)合作的過程中,可能與轉(zhuǎn)售企業(yè)達(dá)成縱向限制協(xié)議。第四章結(jié)合電信產(chǎn)業(yè)作為管制型產(chǎn)業(yè)的特性,探討了通信產(chǎn)業(yè)監(jiān)管機(jī)制與反壟斷執(zhí)法機(jī)制協(xié)調(diào)的問題,以及針對移動通信服務(wù)領(lǐng)域進(jìn)行反壟斷執(zhí)法的過程中產(chǎn)業(yè)監(jiān)管機(jī)構(gòu)與反壟斷執(zhí)法機(jī)構(gòu)合作的問題。結(jié)論部分強(qiáng)調(diào)了在我國移動通信領(lǐng)域放松進(jìn)入管制、引入競爭的重要性,以及在開放競爭的同時(shí)加強(qiáng)競爭執(zhí)法關(guān)注的必要性。
[Abstract]:On the basis of a brief introduction to the resale service of mobile communications in China, this paper analyzes the relationship between the resale enterprises and the basic operators in the two basic links of access and retail in the process of the resale of mobile communications, and then analyzes the relationship between the resale enterprises and the basic operators. Combined with the network characteristics of telecommunication industry, this paper analyzes the position of the market main body in the access link of mobile communication network, especially the dominant position of the basic operator. On this basis, the possible abuse of market dominance and monopoly agreement behavior in access market are forecasted and combed. The article is composed of six parts: introduction presents the background of the selected topic and introduces the related research results of the academic field on the introduction of competition in the field of mobile communications. A simple explanation of innovation and many shortcomings. In addition, this part clarifies the scope of the research, and points out that this paper mainly studies the economic monopoly which may be caused by the resale of mobile communication and does not include the centralized behavior of the operators. In the first chapter, based on the brief introduction of the resale business of mobile communication, the author analyzes the competitive effect of resale business, the related market and the relationship between the operators from the angle of anti-monopoly law. It is pointed out that resale business has the positive effect of promoting competition, at the same time, some behaviors of restricting competition may occur around resale business. The related market for operators to carry out competition is the market of mobile communication service. There is a relationship of cooperation and competition between operators. In the wholesale link, between the basic operator and resale enterprise is the cooperative relationship, but in the retail link, all operators are competitors each other. On the basis of the above analysis, this chapter raises the concerns of anti-monopoly law which may arise from resale business. The second chapter focuses on the analysis of the abuse of market dominance related to resale business, mainly combined with the characteristics of the network industry to analyze the behavior types and forms of abuse of market dominance. It is pointed out that basic operators may abuse their advantages to refuse resale enterprise access, charge unfair high prices or maliciously reduce the quality of access in order to gain an advantage in retail competition. The third chapter mainly analyzes the possible monopoly agreements around resale business, especially the vertical monopoly agreement and horizontal monopoly agreement, and points out that access conditions such as access price may be colluded among the basic operators. In the process of cooperation with resale enterprises, each basic operator may reach vertical restriction agreement with resale enterprises. The fourth chapter discusses the coordination between the regulatory mechanism and the anti-monopoly law enforcement mechanism of the telecommunications industry in combination with the characteristics of the telecommunications industry as a regulatory industry. And the cooperation between industry supervision and anti-monopoly law enforcement in the process of anti-monopoly law enforcement in the field of mobile communication service. The conclusion emphasizes the importance of loosening entry control and introducing competition in the field of mobile communication in China, as well as the necessity of strengthening competition law enforcement while opening up competition.
