我國信用卡收費(fèi)制度的法律完善

【摘要】:信用卡的出現(xiàn)給人們帶來許多便利,日常生活中人們可以使用信用卡透支消費(fèi),它給人們帶來便利的同時(shí),也給人們帶來新的問題與挑戰(zhàn)。為了互聯(lián)網(wǎng)產(chǎn)業(yè)更為健康、有序、長遠(yuǎn)的發(fā)展,首先必須保護(hù)好金融消費(fèi)者的合法權(quán)益。本文以信用卡收費(fèi)的基礎(chǔ)法律問題為切入點(diǎn),針對(duì)信用卡收費(fèi)制度存在的法律問題進(jìn)行分析,提出相關(guān)建議。本文按照提出問題、解決問題的思路進(jìn)行論述,具體而言,本文共有四部分,分別是:第一部分主要介紹信用卡收費(fèi)制度的基礎(chǔ)問題。分為四個(gè)方面:首先,基于商業(yè)銀行“商業(yè)性”和“公共性”性質(zhì)探討信用卡收費(fèi)制度,得出信用卡收費(fèi)及規(guī)避其不合理收費(fèi)的理論來源;其次,介紹信用卡的主要法律關(guān)系,包括信用卡法律關(guān)系的主體以及發(fā)卡行與持卡人之間的法律關(guān)系,并對(duì)此對(duì)法律關(guān)系進(jìn)行重點(diǎn)介紹。其次,介紹信用卡收費(fèi)的特點(diǎn),其是一項(xiàng)基于信用卡合同的民事請(qǐng)求權(quán)且部分信用卡收費(fèi)受國家行政調(diào)控,同時(shí)存在持卡人對(duì)服務(wù)收費(fèi)與收費(fèi)合理性無法量化衡量、收費(fèi)種類較多等問題。第二部分主要是分析問題。以信用卡收費(fèi)糾紛多為依托,總結(jié)出在我國信用卡收費(fèi)制度存在的不足之處,共歸納為四點(diǎn):一是信用卡立法體系缺陷,主要指立法缺乏系統(tǒng)性、立法規(guī)制不完善等問題;二是信用卡發(fā)卡人濫用優(yōu)勢(shì)地位,主要指出存在發(fā)卡人出具格式條款存在不公平、信息披露程度不充分等問題;三是介紹信用卡收費(fèi)存在的不合理情形,主要指全額罰息、溢繳款提現(xiàn)收費(fèi)、違約金、復(fù)利及還款順序不同給持卡人帶來的影響等問題。第三部分主要是域外經(jīng)驗(yàn)的借鑒。本文主要介紹美國和臺(tái)灣信用卡收費(fèi)立法制度及實(shí)踐經(jīng)驗(yàn)。所介紹內(nèi)容主要是以上述問題的解決為落腳點(diǎn)。第四部分主要針對(duì)第二部分提出的三大問題提出解決問題的法律意見。本文提出下列四方面的建議,以完善信用卡收費(fèi)制度,具體內(nèi)容包括:一是健全信用卡收費(fèi)的法律體系,包括制定專門的信用卡法律、完善收費(fèi)定價(jià)法律、加強(qiáng)消費(fèi)者的立法等;二是嚴(yán)格信用卡收費(fèi)信息的披露制度;三是引入信用卡收費(fèi)聽證程序;四是優(yōu)化糾紛解決機(jī)制,包括建立消費(fèi)者投訴數(shù)據(jù)庫、推廣仲裁解決方式。
[Abstract]:The emergence of credit cards has brought many conveniences to people. People can use credit cards for overdraft consumption in daily life. It brings convenience to people, but also brings new problems and challenges to people. In order to make the Internet industry more healthy, orderly and long-term development, we must first protect the legitimate rights and interests of financial consumers. The basic legal issues of credit card charges as a starting point, in view of the legal problems existing in the credit card charges system are analyzed, and relevant suggestions are put forward.This paper discusses the problems in accordance with the ideas to solve the problems, specifically, this paper has four parts, respectively: the first part mainly introduces the basic problems of credit card charges system. Firstly, based on the commercial and public nature of commercial banks, this paper discusses the credit card charging system, and obtains the theoretical sources of credit card charging and avoiding its unreasonable charges; secondly, it introduces the main legal relationship of credit card, including the main legal relationship of credit card and the legal relationship between the issuing bank and the cardholder. Secondly, it introduces the characteristics of credit card charges, which are civil claims based on credit card contracts and some credit card charges are regulated by the state administration. At the same time, there are problems such as the cardholder can not quantify the rationality of service charges and charges, and there are many types of charges. Based on the disputes over credit card charges, this paper summarizes the shortcomings of the credit card charges system in China, which can be summarized into four points: first, the defects of the credit card legislation system, mainly refers to the lack of systematic legislation and imperfect legislative regulation; second, the abuse of the dominant position of credit card issuers, mainly pointing out the existence of credit card issuers. Third, it introduces the unreasonable situation of credit card charges, mainly refers to the full penalty, overpayment cash charges, liquidated damages, compound interest and the influence of different order of repayment on cardholders. The legislative system and practical experience of credit card charges in the United States and Taiwan are introduced. The content of this paper mainly focuses on the solution of the above problems. The fourth part mainly focuses on the legal opinions of solving the three major problems raised in the second part. One is to improve the legal system of credit card charges, including the enactment of special credit card laws, the improvement of pricing laws, and the strengthening of consumer legislation; the second is to strictly disclose the information of credit card charges; the third is to introduce credit card charges hearing procedures; the fourth is to optimize the dispute resolution mechanism, including the establishment of consumer complaints database, promotion of Zhong. Tailor solutions.
