【摘要】：基于行政權(quán)約束的預(yù)算規(guī)則是近現(xiàn)代憲法產(chǎn)生和發(fā)展的經(jīng)濟(jì)基礎(chǔ)和制度前提,而議會(huì)制度則在持續(xù)推進(jìn)財(cái)政民主和預(yù)算法治的過程中實(shí)現(xiàn)地位變遷和規(guī)則優(yōu)化,以實(shí)現(xiàn)"法治國"圖景并保護(hù)公民財(cái)產(chǎn)權(quán)。在準(zhǔn)確闡釋人民代表大會(huì)制度的權(quán)力法源和功能定位基礎(chǔ)上,通過控制與公民財(cái)產(chǎn)權(quán)直接沖突的公共財(cái)產(chǎn)權(quán)來實(shí)現(xiàn)人民代表大會(huì)權(quán)力的實(shí)質(zhì)回歸,是當(dāng)下國家治理理論完善和制度實(shí)踐的可能方向和妥適路徑。在比較借鑒西方國家議會(huì)制度預(yù)算審查監(jiān)督方面的先進(jìn)經(jīng)驗(yàn)基礎(chǔ)上,亦需要綜合考慮中國發(fā)展具體情況以及財(cái)稅體制改革的法治語境。在推動(dòng)審查監(jiān)督權(quán)實(shí)質(zhì)行使、深化人大機(jī)關(guān)專題詢問和漸進(jìn)加強(qiáng)政府首長問責(zé)的憲制基礎(chǔ)上,人民代表大會(huì)作為權(quán)力機(jī)關(guān)對(duì)作為行政機(jī)關(guān)的政府全口徑預(yù)決算進(jìn)行審查監(jiān)督,既因應(yīng)了憲法層面上公平正義的需求,又契合了技術(shù)層面上效率規(guī)則的必要,具有充分的正當(dāng)性和妥適的合理性。
[Abstract]:The budgetary rules based on the restriction of executive power are the economic basis and institutional premise of the emergence and development of the modern constitution, while the parliamentary system realizes the change of position and the optimization of the rules in the process of continuously promoting fiscal democracy and budget rule by law. In order to realize the vision of "rule of law" and protect the property rights of citizens. On the basis of accurately explaining the legal source and function of the power of the people's Congress system, the essential regression of the power of the people's Congress is realized through the control of the public property right which conflicts directly with the citizen's property right. It is the possible direction and proper path to perfect the theory of state governance and the practice of system. On the basis of comparing and drawing lessons from the advanced experiences of the western countries in the budget examination and supervision of the parliamentary system, it is also necessary to comprehensively consider the specific situation of China's development and the legal context of the reform of the fiscal and taxation system. On the basis of promoting the substantive exercise of the power of examination and supervision, deepening the special inquiries of the people's congresses and gradually strengthening the accountability of government heads, the people's Congress, as a power organ, examines and supervises the full calibre final and final accounts of the government as an executive organ. It not only meets the needs of fairness and justice in the constitutional level, but also meets the need of efficiency rules in the technical level, and has sufficient legitimacy and proper rationality.
