【摘要】：競(jìng)爭(zhēng)是政府購(gòu)買服務(wù)制度運(yùn)作的初衷,然而實(shí)踐操作中卻并未很好實(shí)現(xiàn),以致該制度不能有效凸顯優(yōu)勢(shì)。本文擬從分析缺乏競(jìng)爭(zhēng)機(jī)制的制度運(yùn)作入手,予以法律視角的檢視,在尊重市場(chǎng)充分競(jìng)爭(zhēng)原則、競(jìng)爭(zhēng)政策與產(chǎn)業(yè)政策合理協(xié)調(diào)原則的基礎(chǔ)上,試圖在競(jìng)爭(zhēng)法、政府購(gòu)買服務(wù)法與權(quán)利救濟(jì)法方面進(jìn)行政府購(gòu)買服務(wù)競(jìng)爭(zhēng)機(jī)制的初步法律建構(gòu)。
[Abstract]:Competition is the original intention of government purchase service system, but it is not well realized in practice, so the system can not effectively highlight its advantages. Based on the analysis of the system operation of the lack of competition mechanism and the examination of the legal angle of view, this paper tries to study the competition law on the basis of respecting the principle of full competition in the market and the principle of reasonable coordination between competition policy and industrial policy. The government purchase service law and the right relief law carry on the preliminary legal construction of the government purchase service competition mechanism.
