【摘要】：作為一種應用廣泛的法律論證形式,圖爾敏模型由六個基本要素構(gòu)成,能夠比較細致和全面地應用于司法案件的分析。指導性案例23號的裁判理由對該案兩個核心爭議的解決方式非常符合圖爾敏模型。在將該模型引入到分析指導性案例時,需要注意其實質(zhì)和形式上的限度。前者的主要表現(xiàn)是不能完全消除實體爭議,以及容易忽視相關主體的能動性及其互動關系;后者則主要表現(xiàn)在模型的基本要素之間難以形成完整的融貫關系,以及在法律漏洞出現(xiàn)時難以運行等方面。只有充分確定圖爾敏論證模型的價值及其限度,才能夠準確地將其引入到指導性案例的分析之中。
[Abstract]:As a widely used form of legal argumentation, Tulmin model consists of six basic elements, which can be applied to the analysis of judicial cases in detail and comprehensively. Guiding case 23's reasoning for resolving the two core disputes fits well with Tourmin's model. When introducing this model into the analysis of guiding cases, we should pay attention to its essential and formal limitations. The main performance of the former is that the entity dispute can not be completely eliminated, and it is easy to ignore the initiative of the relevant subject and its interaction, while the latter is mainly manifested in the difficulty of forming a complete intersecting relationship between the basic elements of the model. And in the legal loopholes when difficult to run and so on. Only by fully determining the value and limitation of Tourmin's demonstration model can it be accurately introduced into the analysis of instructive cases.
