【摘要】：車輛掛靠經(jīng)營的情形在現(xiàn)實的經(jīng)濟活動中已經(jīng)大量地存在,但我國現(xiàn)行法律及法規(guī)并未對其進行明確、細致的規(guī)定,導致在司法實踐中出現(xiàn)了大量的爭議,尤其對在車輛掛靠運營中發(fā)生的道路交通事故的處理,不同地區(qū)、不同級別的人民法院在認定車輛掛靠協(xié)議的效力、責任主體及責任承擔的方式上出現(xiàn)了不同的觀點與做法,不僅引發(fā)了許多社會問題,影響了道路交通的安全,還嚴重損害了司法公信力與法律權威,同時也關系到受害人的權利能否得到及時有效救濟。鑒于此,筆者首先從明晰掛靠經(jīng)營的概念出發(fā),并剖析掛靠經(jīng)營中的內(nèi)部法律關系,對掛靠協(xié)議的法律效力進行了論證,通過這些分析,筆者梳理出掛靠經(jīng)營過程中發(fā)生交通事故后的責任承擔主體及承擔方式、歸責原則,重點論述掛靠單位的責任主體及責任承擔的方式,最后舉例說明如何在司法實踐中處理車輛掛靠經(jīng)營出現(xiàn)的一系列法律問題,并對車輛掛靠經(jīng)營的未來進行了展望。
[Abstract]:The situation of vehicle linking operation has already existed in a large number of economic activities in reality, but the current laws and regulations of our country have not made it clear and detailed, resulting in a large number of disputes in judicial practice. In particular, regarding the handling of road traffic accidents occurring in the operation of vehicle alignment, different views and practices have emerged in different areas and at different levels of people's courts in determining the validity of the agreement on vehicle alignment, the main body of responsibility and the way in which the responsibility is assumed. It not only caused many social problems, affected the safety of road traffic, but also seriously damaged the judicial credibility and legal authority, but also related to the right of victims to get timely and effective relief. In view of this, the author starts from the concept of clear link management, and analyzes the internal legal relationship in the linked operation, and demonstrates the legal effect of the link agreement, through these analysis, The author combs out the main body and mode of responsibility after the traffic accident happened in the course of operation, the principle of imputation, and emphatically discusses the main body of responsibility and the way of bearing responsibility of the affiliated unit. Finally, an example is given to illustrate how to deal with a series of legal problems arising from the management of vehicle links in judicial practice, and the future of the operation of vehicle links is prospected.
