【摘要】：追求金融效率并非僅放松監(jiān)管,金融安全價(jià)值具有歷史偶然性與政策傾向性,金融法價(jià)值及其制度內(nèi)容具有限度,因此,傳統(tǒng)的"二元論"、"三元論"可待商榷。后次貸危機(jī)時(shí)代,金融法價(jià)值應(yīng)進(jìn)行"新二元化"構(gòu)造,金融效率、穩(wěn)定分別具有公平、安全面相。傳統(tǒng)金融法效率、安全價(jià)值不存在此消彼長(zhǎng)關(guān)系,價(jià)值實(shí)現(xiàn)中市場(chǎng)與政府的主導(dǎo)地位尚待均衡。通過(guò)主體博弈的均衡機(jī)制設(shè)計(jì),解決金融法價(jià)值均衡問(wèn)題,并為具體制度重構(gòu)提供框架,以實(shí)現(xiàn)金融法內(nèi)外體系的相互溝聯(lián)。
[Abstract]:The pursuit of financial efficiency is not only to relax supervision, but also the value of financial security has historical contingency and policy tendency, and the value of financial law and its system content have limits. Therefore, the traditional dualism and ternary theory can be discussed. In the post-subprime crisis era, the value of financial law should be "new dualized" structure, financial efficiency and stability have a fair and safe aspect. There is no relationship between efficiency and safety value of traditional financial law, and the dominant position of market and government in value realization needs to be balanced. Through the design of the equilibrium mechanism of the subject game, the problem of value equilibrium of financial law is solved, and the frame is provided for the reconstruction of the specific system, so as to realize the mutual connection of the internal and external financial law system.
