【摘要】：在商業(yè)秘密司法保護(hù)實(shí)踐中,盡管在立法方面有明確的規(guī)定,但絕大部分的立法規(guī)定缺乏現(xiàn)實(shí)的司法實(shí)踐指引,此時就需要發(fā)揮司法的積極作用。本文著眼于商業(yè)秘密保護(hù)的三個司法審查過程,從商業(yè)秘密的構(gòu)成要件審查、侵犯商業(yè)秘密行為構(gòu)成要件審查以及違法行為的責(zé)任審查三個方面,通過現(xiàn)實(shí)案例分析商業(yè)秘密司法保護(hù)中所存在的價值沖突。主要采取了以案例判決書的分析為基礎(chǔ)挖掘商業(yè)秘密司法保護(hù)中的價值沖突的研究方法。旨在通過案例分析得出,圍繞商業(yè)秘密這一客體所形成的主體關(guān)系中,法院對于主體各自的不同價值追求進(jìn)行價值沖突選擇和評價,然后通過再現(xiàn)價值沖突的司法平衡的過程,解讀法院對裁判標(biāo)準(zhǔn)的適用把握。進(jìn)而,結(jié)合司法審判的優(yōu)化和商業(yè)秘密持有人的利益保護(hù),提出了相關(guān)的啟示建議。
[Abstract]:In the practice of the judicial protection of trade secrets, although there are clear provisions in the legislation, most of the legislative provisions lack the practical guidance of judicial practice, so it is necessary to play a positive role in the administration of justice at this time. This paper focuses on the three judicial review processes of the protection of trade secrets, from three aspects: the examination of the constitutive elements of trade secrets, the examination of the constitutive elements of violations of trade secrets and the examination of liability for illegal acts. This paper analyzes the value conflicts in the judicial protection of commercial secrets through practical cases. This paper mainly adopts the research method of value conflict in the judicial protection of trade secret based on the analysis of case judgment. The purpose of this paper is to draw a conclusion from the case study that in the subjective relationship formed by the object of trade secret, the court chooses and evaluates the value conflict of the different value pursuit of the subject, and then through the process of reproducing the judicial balance of the value conflict. Interpretation of the Court's application of the standards of judgment grasp. Furthermore, combining with the optimization of judicial trial and the protection of the interests of the holders of trade secrets, this paper puts forward some enlightening suggestions.
