【摘要】：黨的十八屆三中全會(huì)啟動(dòng)了全面深化改革的偉大議程,為經(jīng)濟(jì)體制改革中的資源配置方式改革設(shè)定了總目標(biāo),以此為依據(jù),政黨政治引領(lǐng)下的資源配置市場(chǎng)化改革經(jīng)由個(gè)案性的試點(diǎn)實(shí)踐上升為規(guī)范性的行動(dòng)綱領(lǐng)。改革規(guī)劃為經(jīng)濟(jì)法的進(jìn)一步成長(zhǎng)提供了寶貴的歷史契機(jī),并賦予了后者在資源配置法治化進(jìn)程中的嶄新歷史使命,而航班時(shí)刻配置的改革試點(diǎn)實(shí)踐為厘定經(jīng)濟(jì)法在資源配置市場(chǎng)化進(jìn)程中的法律邊界也提供了實(shí)證樣本。在此基礎(chǔ)之上,經(jīng)濟(jì)法應(yīng)當(dāng)設(shè)計(jì)出匹配資源配置市場(chǎng)化改革的制度安排,以期在確認(rèn)改革成果的基礎(chǔ)之上,力爭(zhēng)以規(guī)劃改革方向?yàn)楦邇r(jià)值取向。
[Abstract]:The third Plenary session of the 18th CPC Central Committee launched the great agenda of comprehensively deepening reform and set a general goal for the reform of the pattern of resource allocation in the reform of the economic system. The market-oriented reform of resource allocation under the guidance of political party politics has been transformed into a normative action program through individual pilot practice. The reform plan provides a valuable historical opportunity for the further development of economic law, and endows the latter with a new historical mission in the process of legalizing the allocation of resources. The pilot practice of flight time allocation provides an empirical sample for determining the legal boundary of economic law in the process of marketization of resource allocation. On this basis, the economic law should design the system arrangement to match the market-oriented reform of the allocation of resources, in the hope that, on the basis of confirming the achievements of the reform, the direction of planning and reform should be regarded as a higher value orientation.
