【摘要】：本文選取實踐中掛靠車輛保險理賠的兩起典型案例,從掛靠情形下實際車主和名義車主訴訟地位的確定及民事責任的承擔問題、保險利益的歸屬問題以及免責條款的適用問題三個方面進行深入分析。由于不同案件中的交通事故受害人對于如何選擇掛靠關系的當事人作為訴訟主體具有不確定性,因此會造成最終承擔民事賠償責任的主體及方式也并不確定。此外,在審判實踐中,對于掛靠車輛交通事故民事責任承擔情況存在不同處理方式,掛靠人和被掛靠人均有可能承擔民事賠償責任,又進一步加劇了情況的復雜性和不確定性。根據(jù)保險利益原則,在車輛第三者責任險中只有對于在交通事故中發(fā)生損害的第三者可能承擔侵權(quán)賠償責任的主體,才應具有保險利益。因此車輛掛靠關系下保險利益應當如何確定存在難題。本文通過對案例涉及的實務問題進行梳理和總結(jié),提出以最大誠信原則作為確定保險利益歸屬的新視角,并建議在汽車保險制度改革中對于保險利益進行明確解釋,保險合同各方應恪守誠信原則,通過制定合理的保險條款、強化保險公司主體責任以及建立相關機構(gòu)的聯(lián)動機制等方面,對我國汽車保險制度改革提出有益的建議。
[Abstract]:This paper selects two typical cases of vehicle insurance claims in practice, from the case of the actual owner and the nominal owner of the litigation status of the determination and civil liability issues,The attribution of insurance benefits and the application of exemption clauses are analyzed in depth.Because the victims of traffic accidents in different cases have uncertainty as to how to choose the related parties as the main body of the lawsuit, the subject and the way to bear the civil liability for compensation will be uncertain.In addition, in the trial practice, there are different ways to deal with the civil liability in connection with traffic accidents, and both of them are likely to bear civil liability for compensation, which further intensifies the complexity and uncertainty of the situation.According to the principle of insurance interest, only the subject of tort liability for the third party may bear the liability for tort in the vehicle third party liability insurance should have the insurance interest.Therefore, how to determine the insurable interest under the vehicle link relationship is a difficult problem.By combing and summarizing the practical problems involved in the case, this paper puts forward the principle of maximum good faith as a new angle of view to determine the ownership of insurance interests, and suggests that the insurance interests should be clearly explained in the reform of automobile insurance system.The parties to the insurance contract should abide by the principle of good faith and put forward some useful suggestions for the reform of China's automobile insurance system by making reasonable insurance clauses, strengthening the principal responsibility of the insurance company and establishing the linkage mechanism of the relevant institutions.
