【摘要】：P2P網(wǎng)絡(luò)借貸平臺(tái)投資者信息權(quán)益保護(hù)對(duì)策的提出,從厘清投資者信息的基本概念出發(fā),分析了P2P網(wǎng)絡(luò)借貸投資者信息的范圍、特征、類(lèi)別和法律保護(hù)對(duì)象。這類(lèi)信息的范圍是自然人在P2P網(wǎng)絡(luò)借貸平臺(tái)上進(jìn)行投資時(shí)披露并為信息處理者所掌握的,能夠展現(xiàn)投資者的自然屬性等方面或者反映其交易狀況,可以間接或者直接識(shí)別投資者的信息,核心特征是可識(shí)別性�？蓳�(jù)不同標(biāo)準(zhǔn)劃分為不同種類(lèi)。這些信息反映個(gè)人信息權(quán)客體和個(gè)人信息法益。保護(hù)P2P網(wǎng)絡(luò)借貸投資者信息權(quán)益的必要性分析集中在信息的利益性、信息權(quán)益受侵害現(xiàn)狀和法律保護(hù)困境,揭示了投資者信息兼具人格利益內(nèi)涵和財(cái)產(chǎn)利益內(nèi)涵,而現(xiàn)行法律對(duì)兩種利益內(nèi)涵保護(hù)力有不逮,加之投資者輕視信息權(quán)利、信息處理者處理行為不當(dāng)?shù)纫蛩?P2P網(wǎng)絡(luò)借貸平臺(tái)投資者信息權(quán)益保護(hù)面臨嚴(yán)峻挑戰(zhàn)。對(duì)典型地域的立法例及理論選擇的分析為提出我國(guó)P2P網(wǎng)貸投資者信息權(quán)益保護(hù)制度奠定了基礎(chǔ),該保護(hù)制度包括對(duì)個(gè)人信息權(quán)利及信息法益的私法保護(hù),兼有相關(guān)輔助舉措。鑒于權(quán)利的明確性和法益的不穩(wěn)定性,保護(hù)P2P網(wǎng)絡(luò)借貸平臺(tái)投資者信息權(quán)利最需要法律確權(quán),而保護(hù)P2P網(wǎng)絡(luò)借貸平臺(tái)投資者信息法益最需要一般性條款和司法救濟(jì)。
[Abstract]:The P2P network lending platform investor information rights protection measures, starting from the basic concept to clarify the investor information, analysis of the scope of the P2P network lending investors information characteristics, category and object of legal protection. Scope of this kind of information is a natural person to invest in P2P network lending platform on the disclosure and to master information processing the investor can show natural attributes or reflect the status of the transaction can directly or indirectly identify investor information, core features are identifiable. Can be divided into different types according to different standards. These information reflect the personal information right and personal information law. The necessity of protecting the P2P network lending investors information rights the analysis is focused on the interests of information, information rights infringement status and legal protection of investor information reveals the dilemma, both personality connotation and interests The interests of property and connotation, the present law has not caught on the two connotation of the protection of the interests of investors, and despise the right of information processing, information processing and other misconduct factors, P2P network lending platform information to protect the interests of investors are facing severe challenges. On the analysis of legislation and theory of choice for the typical region put forward China's P2P net loan investors the information rights protection system laid the foundation of the protection system of private law protection of personal information rights and information law, with relevant auxiliary measures. In view of the specific rights and legal interests of the instability, the protection of the P2P network lending platform investor information right the most in need of legal right, and protect the P2P network lending platform investor information method benefit most in need of general provisions and judicial relief.
