【摘要】：當(dāng)今,被譽(yù)為“朝陽產(chǎn)業(yè)”和“無煙工業(yè)”的旅游行業(yè)正以驚人的發(fā)展速度躋身世界上最大的產(chǎn)業(yè)之一。面臨諸多令人堪憂的不良現(xiàn)象和復(fù)雜問題,依法治旅、以法興旅正成為2015年甚至以后相當(dāng)漫長(zhǎng)的一段時(shí)間的解決途徑和必然趨勢(shì)。然而,依靠法治手段改善旅游發(fā)展?fàn)顩r的艱難道路上,各種因素參與其中,道德無疑也是獨(dú)特的作用力之一,它與旅游法治建設(shè)有著千絲萬縷的關(guān)系。目前的旅游法治建設(shè)發(fā)展相對(duì)滯后,尚不能成為和諧旅游的健康屏障,在道德維度的指引下對(duì)當(dāng)前旅游法治建設(shè)進(jìn)行探討和分析,其主要目的在于通過道德對(duì)旅游法治建設(shè)作用的闡述,冀期于從倫理的視角探尋出彌補(bǔ)旅游法治缺陷的途徑和方式。本課題主要研究道德對(duì)旅游法治建設(shè)的支持和作用,首先從道德與旅游法治建設(shè)的概述著手,提出旅游法治建設(shè)的概念和內(nèi)容,旅游法治建設(shè)是一個(gè)由立法、執(zhí)法、守法三個(gè)環(huán)節(jié)構(gòu)成的動(dòng)態(tài)過程,接著重點(diǎn)論述了道德與旅游法治建設(shè)的關(guān)系。其次闡述的是文章的重中之重,提出以道德價(jià)值體系引領(lǐng)旅游立法,關(guān)鍵是良法的創(chuàng)制,同時(shí)探討了旅游良法的生成路徑。緊接著設(shè)定適用旅游法律的倫理路徑,包括旅游執(zhí)法的道德尺度、具體表征、道德路向。最后主要探究為遵守旅游法律法規(guī)提供的一系列德性保障,強(qiáng)調(diào)道德視野下的旅游守法是將外在的強(qiáng)制性的守法行為轉(zhuǎn)變?yōu)閮?nèi)在的自覺的道德義務(wù)。只有以道德為支撐,以法治為保證,旅游市場(chǎng)秩序才能規(guī)范運(yùn)行。
[Abstract]:Nowadays, the tourism industry, known as "sunrise industry" and "smokeless industry", is becoming one of the biggest industries in the world with an astonishing development speed. In 2015 or even after a long period of time to solve the problem and the inevitable trend. However, on the difficult road of relying on the means of rule of law to improve the development of tourism, all kinds of factors participate in it. There is no doubt that morality is also one of the unique forces, which is closely related to the construction of tourism rule of law. At present, the construction of tourism rule of law is lagging behind and cannot become a healthy barrier for harmonious tourism. Under the guidance of moral dimension, this paper discusses and analyzes the construction of tourism rule of law in current tourism, the main purpose of which is to expound the function of morality to the construction of tourism rule of law. This topic mainly studies the support and function of morality to tourism rule of law construction, first of all, it begins with an overview of moral and tourism rule of law construction. This paper puts forward the concept and content of tourism legal construction, which is a dynamic process composed of three links: legislation, law enforcement and law-abiding. Then it focuses on the relationship between morality and the construction of tourism rule of law. Secondly, it expounds the most important part of the article, and puts forward that the key to guide tourism legislation with moral value system is the creation of good law. At the same time, it discusses the generation path of tourism law, and then sets up the ethical path of tourism law, including the moral scale of tourism law enforcement, the specific representation. Finally, it mainly explores a series of moral guarantees to abide by the tourism laws and regulations. It is emphasized that the tourism law-abiding under the moral vision is to transform the external compulsory law-abiding behavior into the internal self-conscious moral obligation. Only with morality as the support and the rule of law as the guarantee can the order of the tourism market be standardized.
