【摘要】：2016年以來,新的監(jiān)管意見明確禁止了平臺(tái)自保的增信模式。風(fēng)險(xiǎn)準(zhǔn)備金和第三方擔(dān)保尚游離于監(jiān)管的灰色地帶。具言之,風(fēng)險(xiǎn)準(zhǔn)備金來源于平臺(tái)自身、借款人(不返還)、投資人時(shí),才有可能屬于平臺(tái)自保;平臺(tái)自設(shè)、控股、參股擔(dān)保機(jī)構(gòu)或者同屬于一個(gè)集團(tuán)公司的擔(dān)保機(jī)構(gòu)提供擔(dān)保,在大多數(shù)情況下(分支機(jī)構(gòu)提供擔(dān)保除外)都是屬于第三方擔(dān)保的范疇。第三方擔(dān)保與風(fēng)險(xiǎn)準(zhǔn)備金并存時(shí)約定賠償順序,有違背強(qiáng)行法之虞。
[Abstract]:Since 2016, the new regulatory opinion has explicitly prohibited the credit enhancement model of the platform's self-insurance. The risk reserve and the third-party guarantee are still free from the gray area of supervision. In other words, the risk reserve comes from the platform itself. Borrowers (not returned to the investors, it is possible to belong to the platform self-insurance; The platform is set up by itself, holding shares, participating in the guarantee institution or the guarantee institution belonging to a group company to provide the guarantee. In most cases (with the exception of security provided by a branch), it falls within the category of third-party security. When third-party guarantees coexist with risk reserves, the order of compensation is agreed and there is a risk of breach of jus cogens.
