【摘要】： 法律移植在中國(guó)法律近代化和現(xiàn)代化的歷程中具有相當(dāng)重要的作用，從清末以來(lái)，百年中國(guó)的法律發(fā)展史就是在不斷移植外國(guó)法的過(guò)程中進(jìn)行的，然而法律移植在中國(guó)歷史上的實(shí)踐也不是一帆風(fēng)順的，這突出表現(xiàn)在新中國(guó)成立后我們以全面移植蘇聯(lián)法制來(lái)開(kāi)展本國(guó)法制建設(shè)所遇到的挫折和困境上。本文以法律移植為線(xiàn)索，系統(tǒng)闡釋了新中國(guó)移植蘇聯(lián)法制的原因、概況和成果，評(píng)價(jià)其得失，并進(jìn)行反思。在此基礎(chǔ)上結(jié)合法律移植的一般理論、探尋其中規(guī)律，在歷史中尋找法治建設(shè)的經(jīng)驗(yàn)和教訓(xùn)，以期真正作到“用法律闡明歷史，用歷史闡明法律�！北疚姆譃樗恼�，第一章論述了法律移植的一般理論及其在中國(guó)的實(shí)踐，并引出其中一個(gè)特殊時(shí)期——新中國(guó)成立后全面移植蘇聯(lián)法制階段，，作出鋪墊；第二章從幾個(gè)角度分析了新中國(guó)全面移植蘇聯(lián)法制的具體原因；第三章主要從立法的角度出發(fā)，分別在憲法、刑法、民法、婚姻法、司法制度、法律教育領(lǐng)域闡述了全面移植蘇聯(lián)法制的概況；第四章以今天的歷史高度為著眼點(diǎn)，客觀(guān)分析了移植蘇聯(lián)法制的積極作用和消極作用，并從法理學(xué)、法律文化以及政治歷史等多角度分析了在全面移植蘇聯(lián)法制后社會(huì)主義法制大廈為何無(wú)法建立的原因。
[Abstract]:Legal transplantation plays a very important role in the process of modernization and modernization of Chinese law. Since the end of Qing Dynasty, the history of legal development in China has been carried out in the process of constantly transplanting foreign laws. However, the practice of law transplantation in Chinese history is not plain sailing, which is manifested in the setbacks and difficulties that we encountered in carrying out the legal construction of our country by transplanting the Soviet legal system in an all-round way after the founding of New China. Based on the clue of legal transplantation, this paper systematically explains the reasons, general situation and achievements of the Soviet Union's legal system transplantation in New China, evaluates its gains and losses, and reflects on it. On this basis, combined with the general theory of law transplantation, the author explores the law and finds out the experience and lessons of the construction of the rule of law in the history, in order to truly "expound the history with the law, expound the law with the history". This paper is divided into four chapters. The first chapter discusses the general theory of legal transplantation and its practice in China. The second chapter analyzes the specific reasons for the comprehensive transplantation of Soviet legal system in New China from several angles. The third chapter mainly from the legislative point of view, respectively in the constitution, criminal law, civil law, marriage law, judicial system, legal education in the field of comprehensive transplantation of the Soviet legal system. The fourth chapter focuses on the historical height of today, objectively analyzes the positive and negative effects of transplanting the Soviet legal system, and from the jurisprudence, Legal culture and political history analyze the reasons why the building of socialist legal system can not be established after transplanting the Soviet legal system in an all-round way.
