【摘要】：家庭暴力是古今中外存在的社會問題,過去很長一段時間里卻被人們忽視,但隨著社會的發(fā)展,文明的進步,許多國家和地區(qū)紛紛針對家庭暴力制定專門的法律。在這些法律中,民事保護令制度被認(rèn)為是,最能有效預(yù)防家庭暴力的法律手段。今年3月1日,我國首部針對家庭暴力的綜合性法律——《中華人民共和國反家庭暴力法》(以下簡稱《反家庭暴力法》)正式實施,引起了社會的廣泛關(guān)注。雖然這部法律的出臺,解決了目前實踐中各省規(guī)定不統(tǒng)一的問題,使民事保護令程序成為獨立的程序,不再依附于離婚訴訟。但是,仔細研究發(fā)現(xiàn),其中對民事保護令制度的規(guī)定過于簡單,不利于今后的實施。本文將著重民事保護令的程序研究,為完善《反家庭暴力法》提出建設(shè)性意見。本文將分為四個部分。第一部分,民事保護令制度概述。這一部分主要對民事保護令及相關(guān)概念進行辨析,明確其性質(zhì),指出民事保護令程序?qū)儆诜窃A程序,并論述其應(yīng)遵循的特殊程序法理。第二部分,我國家庭暴力民事保護制度的發(fā)展、現(xiàn)狀及其存在的問題。本部分包括兩方面內(nèi)容:首先,對我國家庭暴力民事保護令制度的發(fā)展、現(xiàn)狀進行總結(jié)。其次,通過上述民事保護令基本情況的介紹,分析《反家庭暴力法》有關(guān)民事保護令的不足之處。第三部分,民事保護令制度的比較法考察。本部分通過比較研究的方法,考察并分析美國、日本以及我國臺灣地區(qū),在家庭暴力事件中民事保護令制度的相關(guān)規(guī)定。第四部分,對《反家庭暴力法》提出具體的修改建議。這一部分在前面論述的基礎(chǔ)上,提出完善我國家庭暴力民事保護令制度的具體意見,主要包括民事保護令的申請條件、審理程序以及執(zhí)行主體等方面。
[Abstract]:Domestic violence is a social problem at all times and at home and abroad, but it has been neglected for a long time in the past. However, with the development of society and the progress of civilization, many countries and regions have made special laws against domestic violence. In these laws, the civil protection order system is considered to be the most effective legal means to prevent domestic violence. On March 1st this year, the first comprehensive law on domestic violence in China, the Anti-domestic violence Law of the people's Republic of China (hereinafter referred to as "the Law on domestic violence"), was formally implemented, which aroused widespread concern of the society. Although the enactment of this law has solved the problem of inconsistent regulations in various provinces in practice at present, it has made the civil protection order procedure an independent procedure and no longer attached to divorce proceedings. However, it is found that the civil protection order system is too simple to be implemented in the future. This paper focuses on the procedural research of civil protection order, and puts forward constructive suggestions for perfecting the domestic violence Law. This paper will be divided into four parts. The first part is an overview of the civil protection order system. This part mainly analyzes the civil protection order and its related concepts, clarifies its nature, points out that the civil protection order procedure belongs to the non-litigation procedure, and discusses the legal principle of the special procedure it should follow. The second part, the development of the civil protection system of domestic violence, the present situation and the existing problems. This part includes two aspects: first, the development of civil protection order system of domestic violence, the status quo is summarized. Secondly, by introducing the basic situation of the above civil protection order, this paper analyzes the deficiency of the civil protection order in the domestic violence Law. The third part, the civil protection order system comparative law investigation. This part examines and analyzes the relevant provisions of the civil protection order system in domestic violence incidents in the United States, Japan and Taiwan by means of comparative study. The fourth part, to the anti-domestic violence law proposed the concrete amendment proposal. On the basis of the previous discussion, this part puts forward some concrete opinions on how to perfect the civil protection order system of domestic violence in China, including the application conditions of civil protection order, the procedure of trial and the subject of execution and so on.
