【摘要】： 婚姻關系是一個復雜的關系體,它承載著倫理、習俗、國家意志等多重價值訴求,具有多重功能,其調整規(guī)范也相應具有多重性,有些權利義務內容可以基于當事人的意思來調整,也有相當一部分權利義務內容須基于倫理的、政策性的取向而確定,須負載社會歷史的傳統(tǒng)和國家秩序的要求。本文對關于婚姻關系本質的各種學說進行了梳理,并對婚姻關系契約性的客觀存在給予了理論說明。在強調婚姻關系的契約本質的同時,并非否認其他屬性的共生性存在,惟在婚姻關系具有的多重屬性狀態(tài)下,對其中的契約屬性及與之相對應的婚姻關系部分,應自覺運用契約法理和技術加以調整,以實現契約法功能最大化,并以此在婚姻關系領域為私法自治保留空間。本文最后以契約觀為視角對我國現行《婚姻法》進行了梳理與審視,并提出了幾點立法建議,以期能把婚姻關系調整中的契約法原理的功能發(fā)揮到最大,從而對婚姻當事人利益做最好的均衡。
[Abstract]:Marriage relationship is a complex relationship body, which carries many value demands, such as ethics, custom, national will and so on. Some of the contents of rights and obligations can be adjusted based on the intention of the parties, while some of the contents of rights and obligations should be determined on the basis of ethical and policy-oriented orientation, and should be loaded with the social and historical traditions and the requirements of the national order. In this paper, various theories about the nature of marriage relationship are combed, and the objective existence of marriage relationship contract is explained theoretically. While emphasizing the contractual nature of marriage relationship, it is not to deny the symbiotic existence of other attributes, but under the condition of multiple attributes of marriage relationship, the contract attribute and the corresponding marriage relation part are discussed. In order to realize the maximum function of contract law, we should consciously apply the contractual legal theory and technology to adjust it and reserve space for the autonomy of private law in the field of marriage relations. Finally, from the perspective of contract view, this paper combs and examines the present Marriage Law in China, and puts forward some legislative suggestions in order to maximize the function of the principle of contract Law in the adjustment of marriage relations. Thus, the interests of marriage parties to do the best balance.
