【摘要】：父母照護權(quán)制度是大陸法系各國民法中調(diào)整親子關(guān)系的重要內(nèi)容,也是現(xiàn)代親子關(guān)系法律制度的主要內(nèi)容。父母照護權(quán)制度，隨著社會的發(fā)展而不斷的完善，內(nèi)容也隨著時代的變遷而更加充實。父母照護權(quán)制度是由親權(quán)制度演化而來的，父母照護權(quán)與親權(quán)相比，更具時代特色，更符合現(xiàn)代法制的理念。我國沒有規(guī)定父母照護權(quán)，但是社會中存在著很多關(guān)系未成年人切身利益的問題，比如有的父母經(jīng)常虐待子女，嚴重的體罰，甚至逼迫子女走上犯罪的道路。針對這些問題，我國現(xiàn)行法律的空白，，表明了我國構(gòu)建父母照護權(quán)的必要性�，F(xiàn)代法制語境下的父母照護權(quán)制度，強調(diào)的更多的是父母應(yīng)盡的義務(wù)，而不是古代親權(quán)制度中的子女對家長權(quán)力的從屬。我國的現(xiàn)行立法，采用監(jiān)護制度吸收父母照顧權(quán)制度的方式來規(guī)范親子關(guān)系，二者雖有相似之處，但區(qū)別也是很明顯的。在保護未成年人利益的呼聲越來越高的當代社會，我國有必要建立父母照護權(quán)制度。 本文分為三個部分加以闡述： 本文的第一部分闡述了父母照顧權(quán)制度的概念、特征、歷史沿革及其與監(jiān)護制度的區(qū)別。父母照顧權(quán)與監(jiān)護保護的是不同的法益，二者有本質(zhì)上的區(qū)別。父母照護權(quán)在調(diào)整對象上具有其本身所特有的功能，能夠更好地維護家庭的和諧與穩(wěn)定。通過對法律特征的闡述，歷史沿革的分析，指出其具有權(quán)利與義務(wù)的雙重屬性，為進一步研究夯實了基礎(chǔ)。 第二部分論述了我國親子監(jiān)護立法現(xiàn)狀及構(gòu)建我國的父母照顧權(quán)制度的必要性，在這一部分中論述了我國親子監(jiān)護的立法現(xiàn)狀，指出我國現(xiàn)行親子監(jiān)護制度存在的問題有以下幾點：沒有區(qū)分監(jiān)護和父母照顧權(quán)；內(nèi)容概括簡單；沒有將為子女利益作為判定父母離婚后父母照護權(quán)歸屬的最高原則；沒有建立與完善相應(yīng)的監(jiān)督和救濟機制。通過對現(xiàn)狀的分析，闡述了我國現(xiàn)行親子監(jiān)護制度的對于保護未成年人和精神病人的合法權(quán)益的重要意義以及其對于親子關(guān)系調(diào)整的不足之處，進而分析了我國構(gòu)建父母照護權(quán)制度的必要性。 第三部分論述了構(gòu)建我國父母照顧權(quán)制度的建議。在明確構(gòu)建父母照護權(quán)的框架結(jié)構(gòu)后，筆者論述了構(gòu)建我國的父母照顧權(quán)制度應(yīng)遵循的指導(dǎo)原則；在正確原則的指導(dǎo)下，充實父母照護權(quán)制度的內(nèi)容，明確父母照護權(quán)的各種權(quán)能。隨后筆者闡述了父母照護權(quán)的變動體系，說明了在構(gòu)建我國的父母照護權(quán)時，應(yīng)明確父母照護權(quán)的喪失與消滅的規(guī)定，在最后一部分筆者提出在構(gòu)建父母照護權(quán)制度時應(yīng)建立有效的監(jiān)督機制，以保障法律的落實。
[Abstract]:The system of parental care right is an important part of the adjustment of parent-child relationship in the civil law of various countries in continental law system, and it is also the main content of the modern legal system of parent-child relationship.With the development of the society, the system of parental care right is constantly perfected and the content is enriched with the change of the times.The system of parental care right evolved from the parental right system. Compared with parental right, parental care right is more characteristic of the times and more in line with the concept of modern legal system.China does not stipulate the right of parental care, but there are many problems related to the vital interests of minors in the society, such as some parents often abuse their children, severe corporal punishment, or even forced their children to take the road of crime.In view of these problems, the blank of our country's current law indicates the necessity of constructing the parental care right in our country.The system of parental care in the context of modern legal system emphasizes more on the duties of parents than on the subordination of children to parental power in the ancient system of parental authority.The current legislation of our country adopts the guardianship system to absorb the parental care right system to regulate the parent-child relationship, although the two have similarities, but the difference is also very obvious.It is necessary to establish the system of parental care right in the contemporary society where the voice of protecting the interests of minors is increasing.This paper is divided into three parts:The first part of this paper expounds the concept, characteristics, historical evolution of parental care right system and the difference between parental care right system and guardianship system.Parental care right and guardianship protection are different legal interests.The right of parental care has its own function in adjusting the object and can better maintain the harmony and stability of the family.By expounding the legal characteristics and analyzing the historical evolution, it is pointed out that it has the dual attributes of right and duty, which lays a solid foundation for further research.The second part discusses the current situation of parent-child guardianship legislation and the necessity of constructing the system of parental care rights in China. In this part, it discusses the legislative status of parent-child guardianship in China.It points out that the problems of the current parental and child custody system in China are as follows: there is no distinction between guardianship and parental care rights, the content is simple, the interests of children are not regarded as the highest principle to determine the ownership of parental care right after parents divorce;It has not established and perfected the corresponding supervision and relief mechanism.Based on the analysis of the present situation, this paper expounds the significance of the current system of parent-child guardianship in protecting the legitimate rights and interests of minors and mental patients, as well as its deficiencies in the adjustment of parent-child relationship.Then it analyzes the necessity of constructing the parental care right system in China.The third part discusses the suggestion of constructing the system of parental care right in China.After clearly constructing the frame structure of parental care right, the author discusses the guiding principles to be followed in the construction of parental care right system in China, and enriches the content of parental care right system under the guidance of correct principles.Define the various powers of parental care.Then the author expounds the changing system of parental care right, and explains that the loss and elimination of parental care right should be made clear when constructing the parental care right in our country.In the last part, the author puts forward that an effective supervision mechanism should be set up in the construction of parental care right system in order to ensure the implementation of the law.
