【摘要】：隨著我國日趨攀升的離婚率，離婚訴訟案件數(shù)量大幅上升，法院審理離婚訴訟案件中，解除婚姻關系不再是案件的關鍵所在，除了孩子撫養(yǎng)問題，離婚夫妻最關注的就是財產(chǎn)的分割——房產(chǎn)的分割。由于房產(chǎn)價值大，在夫妻財產(chǎn)中所占的比重大。因此，，在相當數(shù)量的離婚案件中，房產(chǎn)如何分割就成為離婚時的焦點問題。我國于2001年4月對《中華人民共和國婚姻法》進行了修訂，最高人民法院先后出臺了三部《婚姻法》解釋，對離婚夫妻的財產(chǎn)及房產(chǎn)分割提供了法律依據(jù)。但在實踐中，離婚夫妻涉及的房產(chǎn)分割情況十分復雜，夫妻雙方就房產(chǎn)分割往往不能達成一致意見，雙方爭議較大，且雙方舉證不足，因此，法院對離婚案件中夫妻房產(chǎn)的分割問題的審理存在一定難度。 第一章主要介紹我國目前《婚姻法》對夫妻共有財產(chǎn)的界定，離婚夫妻涉分割的房產(chǎn)前提應為夫妻共有財產(chǎn)，僅是一方個人財產(chǎn)，不存在房產(chǎn)分割問題。并對共有財產(chǎn)的分配原則和方法進行概述。 第二章主要介紹目前我國司法實踐中離婚案件涉及分割房產(chǎn)的類別和方法，按房產(chǎn)類型、產(chǎn)權性質，對普通商品房、售后公房、農(nóng)村房屋等六種情況的房產(chǎn)分割問題進行闡述。 第三章主要分析了司法實踐中關于審理離婚夫妻房產(chǎn)分割時遇到的常見問題，如夫妻雙方在婚前共同出資購買房產(chǎn)的出資比例認定較難，夫妻實有房產(chǎn)查詢難等問題都給案件審理增加了難度。 第四章主要通過借鑒國外關于夫妻財產(chǎn)制、約定制的立法情況，結合我國實際，對完善和提高現(xiàn)行法律法規(guī)的可操作性，建立夫妻婚前房產(chǎn)備案、婚后房產(chǎn)查詢，提高財產(chǎn)利益自我保護意識等方面提出了一些建議，希望有利于減少因離婚房產(chǎn)分割不清而產(chǎn)生的糾紛，引發(fā)矛盾。
[Abstract]:With the increasing divorce rate in our country, the number of divorce cases has increased dramatically. In court cases of divorce proceedings, the dissolution of marriage is no longer the key to the case, except for the issue of child maintenance. Divorce couples are most concerned about the division of property-the division of real estate. Because of the value of the property, it accounts for a large proportion of the couple's property. Therefore, in a considerable number of divorce cases, In April 2001, China amended the Marriage Law of the people's Republic of China, and the Supreme people's Court successively issued three interpretations of the Marriage Law. It provides a legal basis for the division of property and real estate between divorced couples. In practice, however, the real estate division involved in divorced couples is very complicated, and the two sides often cannot reach an agreement on the property partition, and the two sides are in great dispute. Therefore, it is difficult for the court to deal with the division of matrimonial property in divorce cases. The first chapter mainly introduces the definition of joint property of husband and wife in the Marriage Law of our country at present. The premise of the division of real estate in divorce couples should be the joint property of husband and wife, which is only one party's personal property. There is no real estate partition problem. The principle and method of common property allocation are summarized. The second chapter mainly introduces the types and methods of divorce cases in the current judicial practice of our country, according to the type of real estate, the nature of property rights, ordinary commercial housing, after-sale public housing, Rural housing and other six cases of real estate division to elaborate. The third chapter mainly analyzes the common problems in judicial practice, such as the difficulty of determining the proportion of the joint investment of the husband and wife to purchase the property before marriage. Couples have real estate inquiries and other issues have increased the difficulty of the case. Chapter 4th mainly through drawing lessons from foreign legislation on marital property system and contract system, combining the reality of our country, perfecting and improving the maneuverability of current laws and regulations, establishing the marital pre-marital real estate record and the post-marriage real estate inquiry. Some suggestions are put forward to improve the consciousness of self-protection of property interests in the hope of reducing the disputes caused by the division of divorced real estate and causing contradictions.
